An ordinary Android phone’s location is not uploaded in realtime with location services (actually deactivates the chip) and history turned off. That is fantasy. If it were, process analysis in debugging mode would show suspicious activity which would in turn be used to pinpoint gps chipset access. Packet analysis also would provide clues, even if encrypted. In short, this would have been researched and publicized a long time ago if it happened but it doesn’t.
Having said that, an individual phone might be targeted and surreptitious software installed to do just that. But few of us merit that.
And, of course, there are other ways to track a phone such as passing by cell towers and WiFi access points.

Yes it does and no it does not deactivate. Read your carrier service contract. You agree to let your carrier collect everything they like and it is built into the phone and carrier software. Even if you have all 3rd party apps deleted or disabled this is always there. Does the carrier share it? You bet they do...
