If this case isn't thrown out of court immediately it will be the beginning of the end for the USA. Sovereign immunity. You can't sue the federal government for damages. Of course, I expect Democrats to jump on board this lawsuit and claim the lack of water is another example of the racism inherent in American culture.

Sovereign immunity. You can't sue the federal government for damages. Generally true unless the government waives immunity.
The Federal government has waived some sovereign immunity via the Federal Tort Claims Act. But I am not sure if this type of negligence claim would be covered by that waiver.

You know what? I hope that they win this lawsuit...and others file numerous more after it. Heck...they should demand that the govt build a 7-11 out there to provide slurpees for the illegals as they come across.
The fact that this suit would even be filed is a sign of just bad things are. I'm reminded of an engraving on a sundial at Oxford which states "Its later than you think".
The only way that this country can be saved is if the noses of the white middle class are rubbed in manure so frequently and so blatantly by the lefties that they are finally pushed past their limit. One can only pray it happens in time.

The claim, which must show the existence of injury and ask for damages, is the first step to a lawsuit under federal law. If unanswered within 180 days, the claim can then become a lawsuit. When I first read the story, I assumed the lawyers had already filed a lawsuit. However, upon reading it again, it looks like they filed a claim under the Federal Tort Claims Act. That explains the 180 time limit mentioned in the story. The story is inaccurate in that even if the claim *is* answered, the lawyers can still sue after the 180 day period.

The group got lost and ran out of water during the second day, Lopez-Ramos told authorities. One guide and three immigrants turned back and returned to Mexico. Those four will soon sue due to becoming thirsty.

As I recall my Texas history, Mexico used to be a part of the state of Texas. Maybe Texas should just re-annex them. Of course that would mean we would have to legalize certain drugs. Far as I know, drugs are the only export from Mexico (other than people) and the dems will need something to tax. OK. This is where I put the {/sarcasm} tag, right?

Much of what is wrong with this country comes down to scum sucking, lower than whale sh_t, sell your mother out for a dime, putrid plaintiffs bar. This is just one of innumerable examples, and by no means the worst.

I'm surprised there aren't any posthumous lawsuits by the families of former inmates at Alcatraz. The government should have built a bridge so they'd be safer if they tried to escape the prison.
