The “logic” behind the opinion is so asinine and juvenile that it could only come from judges. Illinois desperately wants to ensure that, within the state’s borders, only criminals have guns. When it comes to law-abiding citizens, the state will do anything to disarm them. That includes passing a law that pretty much bans “assault weapons” (a non-existent category that really covers AR-15s, America’s most popular gun) and large-capacity magazines (which really do exist). On the face of it, Friday’s decision by the Seventh Circuit Court of Appeals to overturn an injunction against enforcement of Illinois’ recently enacted ban on “assault weapons” and “large capacity” magazines doesn’t change circumstances on the ground. The three-judge panel that issued today’s decision had previously stayed U.S. District Judge Stephen McGlynn’s injunction while the state appealed, so the law has been in effect throughout litigation. A federal judge in Illinois has granted a temporary injunction blocking the enforcement of a gun law which bans some semiautomatic rifles as well as high-capacity magazines. United States District Court for the Southern District of Illinois judge Stephen Patrick McGlynn issued the ruling Friday afternoon, stating that the court "must be mindful of the rights guaranteed by the Constitution." The ban, signed by Democratic Illinois Governor J.B. Pritzker in January, includes penalties for individuals who, "Carries or possesses… Manufactures, sells, delivers, imports, or purchases any assault weapon or .50 caliber rifle."

Three federal lawsuits against Illinois’ gun ban made some movement Monday as a federal judge ordered a response from the state to show “each and every item banned.” In the Southern District of Illinois, four cases are pending.
