That’s not this situation, not an acute response to intoxication as this was. It’s referring to changes in the brain from chronic THC exposure resulting in permanent psychotic disorder.

I don’t think the DA can appeal anything in a criminal case. They get “one bite at the apple” as the saying goes. Well she was convicted so the DA has every right and responsibility to appear the sentencing malfeasance.
The sentence is completely inconsistence with thousands of prior rulings.
