DeLay Apologizes for Schiavo Case Rhetoric

House Majority Leader Tom DeLay apologized Wednesday for using overheated rhetoric on the day Terri Schiavo died, but refused to say whether he supports impeachment of the judges who ruled in her case.

At a crowded news conference in his Capitol office, DeLay addressed remarks he made in the hours after the brain-damaged Florida woman died on March 31. "I said something in an inartful way and I shouldn't have said it that way and I apologize for saying it that way," DeLay told reporters.

DeLay seemed at pains to soften, if slightly, his rhetoric of March 31, when Schiavo died despite an extraordinary political and legal effort to save her life.

"I believe in an independent judiciary. I repeat, of course I believe in an independent judiciary," DeLay said.

At the same time, he added, the Constitution gives Congress power to oversee the courts.

"We set up the courts. We can unset the courts. We have the power of the purse," DeLay said.

Asked whether he favors impeachment for any of the judges in the Schiavo case, he did not answer directly.

Instead, he referred reporters to an earlier request he made to the House Judiciary Committee to look into "judicial activism" and Schiavo's case in particular.

I can look back and say that I probably said some realy stupid things when i was 20-25. To bad dumb Judge Greer found heresy as truth!

If you want to be starved to death than go for it, but you can't push your views down other people's throats and no one else and that is exactly what Judge Greer, Michael Schiavo, and Felos did!

Perhaps you will someday learn that there is a distinction between FEDERAL judges and all the others. Congress has authority over FEDERAL judges as per the Constitution. Authority over the rest is, per the Constitution, a State concern. Mixing up such fundamental concepts leads to great confusion.

BTW, this USED to be a very conservative site. I never thought I'd see the day on FR when zealots got away with calling for the impeachment of President Bush and Gov.Jeb Bush because of this issue.

Liberals want them impeached...not conservatives.

Yeah that "legalistic smokescreen", the US Constitution is very inconvenient to those who believe it a Living document such as The Schindleristas. If you understood the document it would be very disturbing but it is clear that you don't so I am less concerned.

Its power ends with allocating jurisdiction and establishing salaries, organization and size of courts. However it cannot tell those courts what to do or how.

That's not at all what Santorum was saying.

He said this Article and Section gives Congress the power to reign in the judiciary.

Someone has given him advice that I'd like to know more about.

The wonderful thing about "the ends justify the means" as an argument is that it's so very flexible. It works just as well for Democrats as anyone else, and what will we say then?

Congress establishes rules of procedure, and other details (e.g., sentencing requirements, statutory remedies, statutory causes of action, etc.), certainly more than "allocating jurisdiction and establishing salaries, organization and size of courts."
