Looks like you are right and the recording is illegal in Mass. That law to me is pure garbage in this case. The guy is on a public street and should be able to tape anything he wants whether it is secret or not. Here is the law:

No problem, I figured that you just missed something.

As for the recording being illegal, well maybe, it would depend on state laws.

In my state it is legal to video anyone in public. Recording their voice is more restricted, although there are some exceptions. I can legally record your voice if you give me permission or if you know I am recording you. If you can see that I am going to record you, you can shut up, but I am not required to shut my recorder off. Additionally, and more to the point of this event, I can record you during an assault or threat of assault or other violent act.

I haven’t read the laws on this for several years, so it is possible that they have changed.... but I doubt it.

Out of curiosity, I went over to Amazon, and they currently sell a HD-quality camcorder with 2 hours of capacity, the size and shape of a cell phone, and will fit in your shirt pocket with the lens peeking out. Just the thing to have discretely turned on when you might be running into somebody “difficult”.

Sometimes the law is an ass as Shakespeare wrote.

If I were sitting on a jury (if a prosecutor were foolish enough to bring it to trial), I certainly would vote to acquit.

It never hurts to remind people to be careful when recording, however.

I completely concur. Any audio/video recording in a public place should be able to be done with no restrictions. Laws such as this are mainly used to protect the guilty, who are often police officers and such.

The recording laws should be based upon a reasonable person’s expectation to privacy.

I would expect a conversation or an action in public view to be public and recordable.

I would expect what happens in a bathroom stall to be private and not recordable, for example.

You are right, too, about law enforcement: you often see an unreasonable reaction to recording their actions even when public. It does make one wonder why...

That guy handled it much better than I would have and he should be commended on his professionalism.

Most people would not have put up with that, especially since her anger was initially over whoever sent her the registered letter.

She maybe racist, but I'm leaning towards just being an evil nut. She got in a fight with paramedics after a traffic accident, she told a bunch of people at a fund-raiser that she'd mow them down with a machine gun if they wronged her, then she threatened to cut the testicles off of the cops who showed up after that rant. Then she keeps calling a black postal worker "nigger" when she gets a registered letter she doesn't want. She was trying to provoke the people she was angry with or taking her anger out on them.

The only thing I'm surprised about is that it took her this long to be outed as a complete psycho, although it sounds like people in her community had a good idea that she was already, especially the police and paramedics.
