It cannot impose penalties on illegals here currently. That isn't the point of the bill. It does remove the incentive to have children here. To try to add penalties against the parents would complicate the matter needlessly, and should be addressed in a separate law. Yes, the child didn't cross the border. But they were born of non-citizens that came here with the intention of circumventing US law, not placing themselves under the jurisdiction thereof. They are being born here in order to circumvent the law. Not an acceptable situation.
Next, it only affects those in the future, not those here now. Ex post facto laws are prohibited. The US Constitution prohibits that specifically, and rightly so. We are looking forward. That is where the focus needs to be.
Just because someone is born within these borders doesn't make them a citizen. They must be born in a condition that is in accordance with the law. Illegals aren't.

The circumvention of the law occurs when the parents cross the border. Intent to violate the law isn’t a crime until they actually cross the border. They are being born in the US in accordance to the law, not in circumvention of the law. Which is why you are trying to change the law.
