They act like this is a “case”, they even say it, “what are the forensics in this case?” I’m sorry, but have charges even been filed against Zimmerman? No. I don’t think so. Don’t believe that there will be charges filed, the media and race baiters have spun this so much to influence public opinion, when the details are clear that it was self defense.

I'm not sure, but I don't think so. I haven't viewed the video (rarely do - I wait for the transcripts) so I'm speculating that this is a witness who claims the police blew her off. I think it's a rehash of Cutcher, nothing new. Cutcher, by her early statements, didn't see the fight. She came on the scene AFTER shots were fired.

I'm not sure if this is Cutcher or somebody else. If the report is accurate, it is NOT Cutcher, because the police have commented about Cutcher.

I don't understand Banfield's "it did not go the way that she and her attorney thought."

This also sounds like a 911 call that hasn't been made public - at least I don't recall one with the phone held so the operator could hear the sounds of the fight.

CNN is being stingy with information on this witness - what does that tell you?

ASHLEIGH BANFIELD, CNN CORRESPONDENT: I did. I was actually quite surprised at a difference in her account of what transpired the night that she saw what happened as Trayvon Martin was shot dead. Now earlier she has said to us that it was very difficult to make out what was going on, about 25 feet from her window.

But one of the things she told us, John, was that the police did not seem interested in how much she wanted to tell them. She told us that she asked the police if she could take them to the location where it happened and kind of reenact a little bit about what she saw happen, and they seemed very disinterested and did not go to the location with her -- again, outside of her window. She also said that she had called 911 and that she talked to 911 all the way through this account, even holding the phone up to her window so that they could hear the yelling.

And then, John, surprisingly, she also said that this week, just two days ago, she's finally had a chance to talk to the state attorney, that officials from the state attorney's office have now finally shown up and asked her some questions. And it did not go the way that she and her attorney thought.

AVLON: Well, have police commented on this witness?

BANFIELD: No, not yet. Other than to say that they're not commenting on the case at all, because it's been taken over by the state attorney. One thing you might be surprised at, the state attorney has a varied job here, John. They've got a couple of jobs they have to do.

Number one, they have to look at the case itself. They're essentially taking over the investigation from the Sanford Police Department, but they're also looking into whether anything went wrong with the investigation with the Sanford Police Department. So, you would think that the interview would be very long, if you have an actual witness in the case.

And this person says she saw it all. Granted, it was a long way away, 25 feet, maybe not so long, and granted it was dark. But she did witness this incident play out. When I join you shortly, you're going to find out how long the interview actually was and what she and her attorney thinks about that.

AVLON: And there were multiple witnesses, right, Ashleigh?

BANFIELD: Hard to say. A lot of people, John, called 911. How many people had a vantage point? That's going to be critical.

Not every piece of information that's come out about this case has come out about this case. A lot of that could be protected and privileged information right now. It might be in the purview of the Sanford Police Department. It might be something that only the state attorneys know at this point.

One thing we can say for sure, a lot of people seem to think they know what transpired between these two parties the night that Trayvon Martin died. But clearly there's a lot we don't know.

Banfield alluded to the obvious - that the eye witness was now giving a more “robust” description in recent days than her original account. THAT is very interesting, given all the media conviction noise being used as red meat thrown to the radical reactionaries who react, seemingly, for a living.

BTW, Banfield started somewhere, got bumped to Court TV and having paid her dues, I take it, has a gig at CNN.

Anyone remember the details of her bouncing career? I kind of like her, so far, and she is very pretty, though taking up with CNN keeps me skeptical that my good opinion will be long lived.

Video: Eyewitness to the Trayvon Martin shooting speaks out - April 7, 2012

Witness claims the yell was the younger person. Could not hear the words. Deeper voice was louder ...

It's going to be pretty funny if Zimmerman sounds like a soprano. We don't know which person has a deeper voice. Lots of speculation in this witnesses testimony.

Larger person on top - what is "larger?"

I think this is an old account - meaning we've heard of it before. I won't be surprised if this is Cutcher. CNN is protecting the identity, witness didn't express pleasure at the interview with state attorney, who would have a record of he previous encounter with police (Cutcher refused to give a statement).

This eyewitness account brings us closer to understanding what really happened. We at AC360 have been trying our best to stick to what is knowable about the case, and discard what can only qualify as speculation.

There was one tape where you can definitely hear the calls for help and the gun shot. IIRC it's the tape where she told the dispatcher she was going upstairs to hide and she kept yelling for Jeremy to “get down” “get back”.

IMO police didn't need her comments about the fight because they had a better closer witness. Who already had given them their statement.

We've talked about surprises. If I were there with my cell I would have recorded it......Hmmmm?

Can't get the calls to come up tonight. IIrC it's call 3.

I have all the calls in one file - that's the way I got it in the first place. No matter.

More pure speculation on my part. As time elapses, Cutcher is making shit up. CNN has no way to correlate this witness with any particular 911 call. So, Cutcher senses 15 minutes of fame coming on, but only if she has a story to tell.

I agree with you, the police have better evidence. Not that they don't want to hear from others, but at some point it becomes repetitive; or the person provides a confused (internally inconsistent) account, etc.

I'm looking for earlier news reports that include a remark about "larger man." I know I saw that before tonight, attributed to an eyewitness.

Watching the video, the reporter is acting like a prosecutor, trying to get the witness to says things that just weren’t true. For instance, the witness makes it very clear early on that she could not understand any of the words of either of the two men in the confrontation. Yet the reporter keeps asking loaded questions trying to get her to say, essentially, that Zimmerman was making aggressive and racist statements to Martin. She also was trying to get the witness to say that the police didn’t care about anything she said, but the witness insisted that the police did ask her to tell them everything she heard and observed. The reporter didn’t like that and seized on the witness’s statement that she offered to go show the police where exactly the two were standing, but they said she didn’t need to. The reporter was definitely trying to prove a specific spin on the story.

Worked placing voices in choirs for over thirty years. Heavy set men tend to have higher voices (think of the three tenors) because the fat actually makes the length of the vocal chords that vibrate smaller. Zimmerman did not support his tone (another weight issue) when he was in the truck. (He may have been ‘whispering’. His speaking voice is right in the range of a tenor, produced from the throat and not from the diaphragm, which is usually a “girl” thing.
He had no resonance when yelling for help possibly because of TM sitting on his belly. He was under stress which causes pitch of voice to go higher (think Sarah Palin)

The size of vocal chords determines the range of the voice. There hereditary, just like shoe size etc. Listening to his father and brother, who also have a higher pitch speaking voice, George is definitely a tenor.

To those claiming witness tampering, you might want to back off on that and see what's actually going on. The person claiming that the police corrected her when claiming that she heard Martin calling for help is Mary Cutcher, the short haired blonde hottie that I totally want to bang.

The first thing to remember is that we haven't even see a copy of the statement she gave to police so we have no idea what it contains. We also have a witness that appears to keep changing her story if you watch her numerous interviews.

Secondly, this is the same woman who has claimed in interviews that she's certain that it wasn't self defense and that Zimmerman didn't need to shoot somebody that was half his size. She has an obvious bias even though she admits she didn't look outside until after the shooting and has no idea what actually happened. She also claims to know it was Martin screaming for help because the screaming stops after the gunshot.

Next we have her roommate (bullshiat, they're totally lesbians) saying that when she looked outside, it was so dark that she couldn't see anything and that she has no idea what was going on. They then claim there was no indication of a fight, after admitting that it was to dark to see anything. She also indicates in a later interview that it was too dark to see Zimmerman's face when asked if Zimmerman was bleeding.

Then we have the police claiming that Cutcher has been changing the story that she gave to the police. She was recently on Anderson Cooper and he questions her about her inconsistent statements. Watch the interview and you'll see her stumbling on her words while trying to explain the inconsistencies in her story.

This chick is totally unreliable but totally hot. Call me, Mary, you sexy little lesbian pixie.

I wouldn't invest much thought energy into the pitch of the voices, as told by this witness. There is better evidence, and other kinds of evidence.

This is just CNN making ratings for itself, I think. I'm going to look for Cutcher's appearance on CNN earlier - tonight's show indicated this witness has been in contact with CNN for some time.

The police were interested, by their account. They asked her if she'd sign a statement and she didn't want to.

Addendum; ASSUMING that this witness is Cutcher. If it's Cutcher's roommate, she signed a statement.

Martin was 6’ 3” (He had grown 3 inches since getting license).
Zimmerman 5’9” His weight wasn’t given since he had recently lost weight.

In the police video with the cop looking at Zimmerman’s head he didn’t look more than 160 to me. Unless he was solid muscle, that would be more. He is not a big fat man at all.

Not just the length of the vocal cords. Heavier men often are estrogen dominant and that can have an effect on the voice as well.

That’s about right. But he had been heavier and recently lost weight. IMO He needs a vocal coach or he’s gonna end up with vocal nodules. He’s not supporting the sound and speaking from the throat.

Sarah P has a similar problem.

Necessarily long dumps here. Tonight's witness's story sounds EXACTLY like Cutcher's story of March 20.

Martin's lawyer's are playing a logic trick (I hesitate to call it clever, but it will fool lots of people) where they cite conflicting witness accounts, say that creates reasonable doubt, therefore there should be a trial. If that was the standard that police used, then any nutcase can make a fabricated claim, and "create" reasonable doubt. Here, we have witnesses who admit not seeing the altercation, so they create a view, based on sound only, of what they think was going down. That is insufficient basis for reasonable doubt. Reasonable doubt is to be based on reason, not on speculation.

COOPER: David, appreciate that.
Mary Cutcher and Selma Mora Lamilla live in the gated community where Trayvon Martin was killed. Mary was one of the people who called 911. They both say the police were siding with George Zimmerman from the start. I spoke to Mary and Selma about what they saw and they heard on that day.

(BEGIN VIDEOTAPE)
COOPER: So you heard some sort of whining, some sort of commotion outside?

MARY CUTCHER, NEIGHBOR: I was in the kitchen with the window open and the blinds pulled. So we had complete view from outside.

COOPER: What was the first thing you saw?

SELMA LAMILLA, NEIGHBOR: By that time, like shot -- like some other noise.

COOPER: You heard the gunshot?

Lamilla: Yes. And I run away from my backyard, and when I just get into the point of my -- like my screen, it stopped me, I look at that person on his knees on top of a body.

COOPER: So you saw Mr. Zimmerman on top of Trayvon Martin?

LAMILLA: Exactly.

COOPER: When you say on top of, how so?

LAMILLA: He was...

CUTCHER: Straddling him.

LAMILLA: Exactly.

COOPER: His legs were straddling him?

CUTCHER: One on each side, on his knees, with his hands on his back. I immediately thought, OK, maybe -- obviously, if it's the shooter, he would have ran. I thought maybe he's holding the wound, helping the guy, taking a pulse, making sure he's OK. And when she called to him three times, "Everything OK? What's going on?" Each time he looked back, didn't say anything.

And then the third time he finally said, "Call the police."

LAMILLA: But at that time it was so dark. I just saw this person. When she started calling the police, I saw Zimmerman walking with -- touching like his hair, like kind of like confused back and forth to the body. And -- and...

COOPER: So he was sort of pacing back and forth?

LAMILLA: Yes. Like, like -- oh, my God.

CUTCHER: He's pace and go back to the body and just like -- I don't know if he was kind of "Oh, my God, what did I do? What happened?"

LAMILLA: Something like that.

COOPER: So you didn't hear or see any altercation, any struggle?

LAMILLA: No.

COOPER: You only heard the cry, or the whimpering as you describe it, and then the shot?

CUTCHER: Yes.

COOPER: So you believe whatever altercation or tussle or whatever there was, you believe that happened elsewhere, but you didn't witness it?

CUTCHER: I believe that it had -- it had to have started from where the first person that called 911 and said, "There's a fight right outside my porch."

COOPER: How far away is that person?

CUTCHER: It's a couple doors down. And from that point to where his body was, you know, two or three doors down, it's hard for me to believe that -- and at the time that we heard the whining and then the gunshot, we did not hear any wrestling, no punching, fighting, nothing to give -- make it sound like there was a fight.

COOPER: When police now have said -- you gave an interview to a local station. Police have said what you said in that interview, what you're saying now is -- is contradicting what you told them early on. That your initial statement to police actually backs up George Zimmerman's version of events.

CUTCHER: Actually, when that was released I called the PR guy for the chief of police, and I demanded that they retract it and print the truth.

COOPER: They say that when they initially contacted you, that you didn't want to make any kind of a statement.

CUTCHER: They never...

LAMILLA: Can I say something about it? It's because that why I just decided to speak in public. I was the one that I never wanted to...

KUTCHER: She was the one...

COOPER: You didn't want to make a statement?

LAMILLA: Exactly. Well, I did, because she wanted (ph), but I didn't want to be in cameras.

COOPER: Right.

LAMILLA: When she said, we need to help the family, I said no, I don't want to go in the cameras.

COOPER: So when police say that your initial statement backs up Zimmerman's...

CUTCHER: I don't know how it's any different from what I said in the original interview, when I did...

COOPER: So what you're saying now tonight is the same as what you told the police initially?

CUTCHER: Absolutely. I said nothing different. The only thing I can think of that would have any difference whatsoever is they asked me how would you know that it was Trayvon that was whining? And I said, "I don't know. I guess because it stopped when the gun went off." And if it were Zimmerman crying, because he was hurt or something, I think he would have continued. I don't know.

What I heard was a very young voice and it stopped immediately when the gun went off.

COOPER: Based on what you saw -- and again, you didn't see a struggle -- do you believe it was self-defense? On Zimmerman's part?

CUTCHER: I did not.

COOPER: Why?

CUTCHER: Originally, I didn't believe it was self-defense because of what we saw when we walked out on the porch. If it was self-defense, why was he on his -- on Trayvon's back?

COOPER: What was your -- your impression of the police's attitude towards this? Did you form an impression?

CUTCHER: They were siding with him.

COOPER: With Zimmerman?

CUTCHER: Yes.

COOPER: What makes you say that?

CUTCHER: I guess just their nonchalant attitude. Because he's in, you know, classes to be a police officer and, you know, he had a squeaky clean background, which he does not. It has come out what his background is. And let him go.

COOPER: Well, thank you very much for talking. I appreciate it.

CUTCHER: Thank you.

LAMILLA: No problem.

Anderson Cooper - March 27, 2012

[ANDERSON COOPER] We're also now learning that there are competing narratives from others including the Sanford Police. There's a leaked account of George Zimmerman's statement to police suggesting that Trayvon Martin confronted him, punched him in the face and slammed his head into the -- to the ground. At least two eyewitnesses apparently confirming that account of Trayvon Martin as the aggressor. And one eyewitness saying it was George Zimmerman actually who cried out for help.

But another person who heard the scuffle but only saw the aftermath seems to contradict it.

(BEGIN VIDEO CLIP)
MARY CATCHER (sic), WITNESSED SHOOTING AFTERMATH: Zimmerman was standing over the body with -- basically straddling the body with his hands on Trayvon's back. And it didn't seem to me that he was trying to help him in any way. It didn't seem to me -- I didn't hear any struggle prior to the gun shot. True. But estrogen can effect the tyroid that puts pressure on the vocal chords decreases the size of chords. A lot of vocal nodules in that group.

Read that the other night. Since the gun had already been heard. It appears that Zimmerman was no longer under TM but had his hands on his back trying to stop bleeding/get help. Don't see anything inconsistent with what Z had told others.

Notice the valley talk in transcript, like man, like....WOW.I'm gonna milk these fifteen minute like to sixteen or maybe like to eternity and beyond .

And she expects LeO to take her seriously. Like gee. I mean.

It's still the gap between hanging up from dispatcher and getting punched in face that needs a witness.....This one is like ....ummm ....a fail.

Witness, Zimmerman attorneys address key questions in Trayvon shooting - CNN - April 7, 2012

The witness declined to characterize her questioning by investigators as "in depth," instead saying "I just kind of told what I saw and heard."

She noted that when she offered to show the investigators where she saw the scuffle occur, she was told, "Nah, we don't need to see it."

She added that two phone calls to the lead detective have gone unanswered.

Her attorney, Derek Brett, said a follow-up visit on behalf of the state attorney's investigation on Wednesday yielded only 15 minutes of questioning.

"It was very general," Brett said, adding that had he been in the investigators' position, he would have had her recount her story again.

You'd like to have one, but sometimes you have to piece together the most likely scenario with other evidence.

Zimmerman, armed, watching out for the neighbors, has called the cops. So, he decides he's going to punch Martin while waiting, but Martin gets the better of him ... yeah, sure.

Add it what we know about Zimmerman's conduct in numerous similar situations (suspicious people, he calls police), Zimmerman's cooperation with the investigation, etc. I'm trying to find contemporary evidence that cuts against Zimmerman's account, and the only things that appear are speculation/fantasy.

She's getting expenses paid, for sure. That can be spartan, or it can be lavish. CNN knows how much to offer people to get them to come in - Cutcher would do the work cheap.

I give the information in tonight's AC360 witness program the same level of credibility as "no injury on Zimmerman" video of earlier in the week. Curious if it is a rerun of Cutcher, for sure, but other than that, this is just CNN being drama queen, itself.
