The White House and the lapdog media have an unusually depressed, belligerent tone when it comes to the upcoming opinion on Obama Care. They’re even more depressed than they should be given the pathetic showing their case (not their lawyer, but their case) made during oral argument. Put another way, it’s hard to believe that, after two years of intellectual denial, they can’t also deny away a single day of bad argument. Their malaise is due to something greater than one bad day.
This bizarre black cloud leads at least one Supreme Court observe to suspect that the unthinkable happened — the formerly leak-proof Supreme Court leaked (emphasis mine):
It doesn’t take a Washington insider to suspect that the White House has a back channel to the Supreme Court, knows how the justices have come down in the Obamacare case and has learned, from the Obama point of view, the news isn’t good.
The president’s defiance and what appeared to be his campaign of intimidation targeting the justices has morphed into barely concealed resignation over the last seven days.
That widely noted New York Times story of the weekend is a case in point. It detailed how the smartest crowd (hasn’t the MSM assured us of it) that has ever inhabited the nation’s Executive Mansion failed ever seriously to consider that seizing control over one-seventh of the American economy and forcing every American to buy a commercial product might, just might, run afoul of our constitution of liberty.
At Power Line, where I first stumbled across this leak theory, Steven Hayward points out that, in the past, a combination of judicial discipline and law clerk career fear kept the Court silent:
Why is the Supreme Court better than the intelligence community at keeping secrets? The nine justices are disciplined enough, but what about their clerks, who surely have night lives, close friends, etc.? Possibly the problem of ruining their promising subsequent legal careers (and the not insubstantial ethics clearance they might blow by leaking) explains it, but it is still a marvel that the Court’s decorum has held for this extraordinary case.
I’ve known former Supreme Court clerks and, yes, their eye is on their future career. They are not the type of people who would carelessly jettison that future. But there is someone on the Supreme Court whose future is already assured, who has proven herself to be a shill to the monied powers, who once worked hand-in-glove with this White House, and who is a total Progressive ideologue, who has regular placed politics against principle. She’s also a newbie, which would explain why I’m not talking about Justice Ginsburg, who has kept mum during her tenure. Yes, Elena Kagan, I’m talking about you.
This is pure speculation. I’ll never be able to prove it. Nevertheless, if there is a leak, which is a guess, I’m further guessing that Kagan is the leaker.

i cannot fathom how this dirtbag got away without recusing herself from hearing the case as she worked on Obamacare as solicitor general. She is a leaking conflict of interest.
Yes, it was leaked by a clerk or kagen. The VOTE was weeks ago and the bill couldn’t be severed so all one had to do was signal a yes or no. There are dirty commie clerks at the supreme court, that has been proven recently by court cases regarding soetoro eligibility. Papers go missing, not docketed, sabotage etc.
Wasn’t she spotted dining out wth Cruella Deville (Sebelius) not that long ago? Of course 0bama has an inside scoop.

...which begs the question: If it can be proven that she, in fact, is in league with the White House and actually “leaked”, then what can be done? Can a SC Justice actually be fired/impeached?

Justices are appointed for life. They can be impeached and upon conviction in a Senate trial removed from office.

Yep, OBVIOUSLY a tip-off. Back when it was argued, I think on a Tuesday, the people that understand the Court said that the judgement would be known by Friday, of that week as that’s when the judges vote, secretly. The rest of the time, from then to now, was writing the edict (sorry, I meant ‘opinion’) of the court.
So, back then, Obama blew a gasket, on SATURDAY - the day after the vote. It was an informal vote, but those usually hold.
...of course he knew what was coming.

What’s more hypocritical was she recused herself from Arizona case, but not Obamacare. Tell me the difference between the two,she should have for Obamaca as well.
I suspect that, for her, politics is more important than ethics or tradition. She’s already attained a high life-time position, so she feels untouchable.

Justices can be impeached and removed. House I peaches, senate tries and can remove. Only 1 justice ever has been impeached, multiple charges. Senate acquitted him.

Doesn’t really matter. SCOTUS clerk is an important ticket-punch for a long and successful career as a jurist - or even just a high-power lawyer. To be caught leaking would make that ticket punch into a universal black mark.
Once you have betrayed the legal oligarchy, you can no longer depend on them for a lifelong avocation.
If I were an associate justice, I would rule and write the per curiam opinion that since the US Senate provided the necessary consent, then their appointment would be binding

You are comparing apples and oranges....Obama was certified eligible by each state by being put on the ballot, then he was elected by the people in a certified election and by the electoral college.....so he already passed the tests to be president....He cannot be unmade....
So in a sense if you use the CDL analogy....He can’t be fired because the owner already said....hire him for this one trip ...The people spoke...

He was not chosen by the people...he was elected under law, and sadly, he misrepresented who he was...and at the time that false representation was in violation of law. IT REMAINS A VIOLATION OF LAW. You cannot spin it any other way.
Misrepresenting yourself to be within the law is not inexcusable once those representations are found to be untrue. There are no apples and oranges here...truth, lies and revelations! It's really that simple.
