By placing the ACA under the umbrella of the tax power, Roberts may have made the ACA easier to overturn by several orders of magnitude. The ordinary process, of course, requires 60 votes to overcome a filibuster in the Senate. But when it concerns budgetary matters, including taxes (like the Bush tax cuts), 51 votes are sufficient to put the law on hold for 10 years. So, theoretically, 51 Republicans will be capable now of overturning the ACA at least for ten years (at which point it could be reviewed again). Fifty-one Republicans could have attempted this in any case, but now they can do so with much greater plausibility because this is a matter of taxing and spending and not regulation of commerce.

You’re assuming we’ll have 51 votes in the Senate after the election. Not just 51 Republican Senators but 51 willing to vote it down.

The fastest way to repeal this is to go after the wavers. HHS can’t wave taxes and if the Republicans insist that everyone pay “their fair share”, it won’t take long for it to be repealed.

Bull hockey. Levin has arrived exactly where his logic took him. He excoriated Ron Paul over simple Constitutional principals that logic says he would agree with. But illogically he choose to attack the Constitution in order to diminish a candidate he didn’t like. He reaps what he sows. Mark Levin used to be one of my heroes but now he is just another frickstick for the man.

Huh? There will be many more lawsuits coming and it’s always possible the SCOTUS reverse itself on many aspects of Obamacare, NOW THAT IT’S OFFICIALLY A TAX. Obama’s 1,200 hand picked Waivers without approval from Congress, for one. I would love to see 1,200 Obama-buddy companies have to stick Obamacare up their a** and live with it.

Battle is tedious, some are lost, but nothing is lost - there are still things that can be change. War is still on, I have written many times, make sure you have true conservatives in two Chambers of your Government, and clean the house your style.

Let logic prevail, not emotions, none of this you are doomed, yes its painful to watch, but by watching and crying, nothing will be done.

Only you together as people of Constitution Republic can do this, yes there is this Electoral Votes, so ....who represents you to make a difference...You will get those if you put your heads together friends.

Last laughter belongs to you if you put yourselves together and go on attack, now that is official and I new it is a tax gives you plenty of ammunition, just calculate probability and go with Sun Tzu style - knock them out in their own turf...Enemy made fatal mistake use it for your advantage with logic, and no pity.

I have been thinking the same way. Cut out the exemptions, especially for muslims, and let the bombings do their job.

This bill was passed by reconciliation...it can be repealed by reconciliation.

The ACA DOES NOT HAVE A SEVERABILITY CLAUSE…

If one part is nixed, the whole must be also???

There are an awful lot of “if’s” out there. If Romney wins, if we capture the Senate, and “if” that combo actually act to repeal Obamacare. It’s an issue now, but come January they might all see it differently.

Obamacare has to be replaced with something. The current system is absolutely destructive and cannot continue. But, the same bunch of slugs couldn’t even end the sugar subsidy.

This is not going to be overturned. The left would come unglued and burn the f***ing country to the ground. It would be like Wisconsin X 57. SO, if it must stand, everyone from barry on down should have to have this same plan including all the federal, state and all union a-holes. If it good enough for me it should be good enough for everyone. Let hairy bring that to the floor and see if it fly’s.
