Opinion on People who illegally park in Disabled Parking Spots
Indiana Code ^ | 07 JAN 2013 | BCW

Posted on 01/07/2013 7:07:17 AM PST by BCW

This is what the State of Indiana Code states:

IC 5-16-9-5 Violations; Class C infraction and Class C misdemeanor Sec. 5. (a) Any person who parks a motor vehicle which does not have displayed a placard of a person with a physical disability or a disabled veteran, issued under IC 9-14-5 or under the laws of another state, or a registration plate of a person with a physical disability or a disabled veteran, issued under IC 9-18-18, IC 9-18-22, or under the laws of another state, in a parking space reserved under this chapter for a vehicle of a person with a physical disability commits a Class C infraction. (b) Any person who knowingly parks in a parking space reserved for a person with a physical disability while displaying a placard to which neither the person nor the person's passenger is entitled commits a Class C infraction. (c) Any person who displays for use in parking in a parking space reserved for a person with a physical disability a placard or a special license plate that was not issued under IC 9-14-5, IC 9-18-18, IC 9-18-22, or under the laws of another state commits a Class C misdemeanor. (d) A person who, in a parking space reserved for a person with a physical disability, parks a vehicle that displays a placard or special registration plate entitling a person to park in a parking space reserved for a person with a physical disability commits a Class C infraction if that person is not, at that time, in the process of

transporting a person with a physical disability or disabled veteran. (e) Notwithstanding IC 34-28-5-4(c), a civil judgment of not less than fifty dollars ($50) must be imposed for an infraction committed in violation of this section.

Too many spots, too many stickers, and too much abuse has rendered the system worthless. Its become parking-spot welfare ... where the abuse by the many entitled far outweigh the benefit to the few truly needy. Two days ago ... I saw an H2 with a handicapped sticker parked across two spots. If you can get in and out of an H2, you don’t need a sticker.

These days, its more about revenue than about the handicapped anyway. I think they should do away with them altogether.

Texas has increased fines for each violation, up to (IICR) $1500 for the sixth violation. There’s also community service, etc., mandatory

Abuse of handicapped spaces and license plates had desensized a lot of people to illegal parking in those spaces. It sounds to me like you case is legitimate, but a lot of folks seem to get them because they are too lard-assed to walk fifty feet to an entrance.

I would never park in a handicapped spot illegally because I find inconvenience trivial, and the idea of depriving a truly handicapped person of the spot beyond odiuous.

Was it right? Probably not

When I was a kid, I parked in a handicapped spot at the local town hall. I think that every guy at the fire station nearby was headed towards me...and they weren't coming over to discuss baseball.

Then, my Mom (who had just had knee surgery) got out of the passenger side, figured out her crutches, and slowly hobbled in. Problem solved. :-)

Perfectly "abled" people who park in handicapped spaces are a real pet peeve of mine. Even more so are the idiots (and it seems like there are a lot of them in the area where I live...I'd not noticed it, really, until I moved to the Southeast) who park in Fire Lanes at the mall, grocery store, etc. It's nothing but sheer laziness, screws the traffic patterns up, and could really mess things up in the event of an emergency.

IMHO, Handicapped spots are for people who *need* them. Too bad that we live in a society where a card is needed for use, and the simple act of having a card proves the need. I'd not feel too guilty about your one "incident", if I were you. :-)

My SIL used her MIL’s placard while borrowing MIL’s car for months. She then bought the car from the estate when the MIL died and is STILL using the placard. She’s really fat, but she ain’t handicapped, and she justified it to me (without my even point it out - guilty much?) by saying that when she bought the car, she bought the sticker, too.

Some folks just have a worldly, get-mine mindset.

I know someone who contracted polio as a child and is paralyzed from the waist down. His advice for what to do with able-bodied people parking in handicapped spots: break both their kneecaps. If they want to be disabled, we should humor that request.

What country do I live in?? It use to be called the land of the free and the home of the brave, but, unfortunately, nanny staters likes yourself are bringing it to an end. I bet you even go around to some of your neighbors and measure the heighth of their grass to see if they are in compliance with local ordinances. Before even clicking on your name I was sure you were a north eastern yankee.

No, you are definitely not being too sensitive.

My dad is in a wheelchair (due to Parkinson’s disease) and once, when I took him to a physical therapy appointment, one of the handicapped spaces (of which there were too few anyway) was taken by a truck that looked like it was used by someone doing construction or painting perhaps. Since there was a construction company a few doors down, I walked in there and told the group of people that whoever is illegally parked in the handicapped spot had best move or pay a $250 fine because I was calling the police.

The truck was moved in a few minutes time.

I’d report that car to the police if I were you.

More like mischief, but you're right.

Let me fix that.

Let air out of 2 tires. Most people have a spare tire, hardly anybody has 2 spare tires. Drawback is, the car will sit longer illegally in a disabled designated spot.

We have the same situation here...
My 88 yr old dad can’t walk that far but we drop him off and never use the HC slots...
My pet peeve at our small town grocery store are the courtesy slots for moms’ with infants or toddlers...inevitably, when I am at the store, someone without kids takes advantage of those slots and are very in-your-face about it.....and, yes, I’ll go there...they are usually fat and black!

“I’d not feel too guilty about your one “incident”

I don’t. Simply because I don’t know of any other options that I had. The scripts required I.D. to get them and the pharmacy wouldn’t hand them over to one of my kids. They also wouldn’t hand them over to a neighbor. My husband was out of town for two days. It was one of those “what else can I do” moments and I decided to break the law. I figure if this is the most wild and crazy that I get... I’m either trying to do right or living a really boring life (perhaps both!)

“.. some folks just have a worldly, get mind mindset”.

It is almost like, “Why should a person in a wheelchair get better parking than me”. No different than someone hating another person for making more money or owning a nicer house/car. I’m afraid to say but our society is full of folks like that!

Breaking both kneecaps seems a bit harsh; I would think breaking just one kneecap would be sufficient. But that’s just me.

Geez, guy, get over yourself. We are a law abiding country, or, at least, we used to be and thanks to people like you - apparently breaking the law is ok with you. Are you a friend of Barry’s? Of the 94 people who have seen this thread thus far, you’re the only one going off the deep end. Hmmmm, must be you my friend with the problem not me.

oh - I was a state trooper before I got into national intelligence...I have detailed photo’s of how and the way the vehicle was parked - with the driver ID in the vehicle - and his plate...wrote up a report and sent it and the photo’s to the chief of police - which knows my background - from policing - to MP CPT - to Blackwater operative...yeah - I got that covered...Prayers for your Dad - it those of us that can stand up for those who can’t - will always win!

I got the photo’s on my droid - several of them at different angles - and wrote up a report and handed that over to the chief - and yes, the admin are afraid of the donors because they need the funding more than they need one disabled child with cerebral palsy! ...pretty sad state of affairs these days...
