The President has been back out on the road again, spinning heartwarming tales and pushing for his second term agenda, as youd expect any recently reelected leader to do. Ill confess that I had a hard time paying attention to a lot of it, what with asteroids crashing to Earth on poop filled cruise ships and all, but there was one theme which caught my attention. Hes going all in on the hot new fad of comprehensive immigration reform.
President Barack Obama told a group of Senate Democrats Wednesday that Congress must move forward with comprehensive immigration reform, or else he will propose his own legislation on the hot-button topic
In a description of Wednesdays meeting, the White House said Obama reiterated the key principles he believes must be a part of any bipartisan, commonsense effort, including continuing to strengthen border security, creating an earned path to citizenship, holding employers accountable and streamlining legal immigration.
Everyone seems to be talking about it these days, and not just Democrats. Republicans from Marco Rubio to John McCain have their own proposals, many of which involve some form of what the President is talking about. You can call it a path to citizenship or amnesty or Expedited Entry whatever you like. But for some reason there are still quite a few of us who hear proposals such as these and get an uneasy feeling. For some of us, it may even be hard to quantify exactly whats wrong. But if you harbor any such qualms, of course, you will be immediately labeled say it with me
Whatever. But as I considered the question this week, I realized that there might be a better way to describe exactly why this sounds troubling...

Not every illegal alien is dark complected.
ICE recently deported a whole group of Isaelis from San Francisco, and deport white Europeans regularly without hesitation.
This isn’t considered racist on the part of ICE, now is it?
I believe the correct assumption would be that it is politics, plain and simple.

I'm a lawyer, but not an immigration lawyer, so this may be out of date, but the last time I looked this up, entering the country illegally was a crime, but entering legally (e.g., on a tourist or student visa) and staying illegally (overstaying your visa) rendered you civilly deportable but wasn't a crime.
Covers illegal entry. New York City is full of illegal aliens (mostly Irish and African). They didn't swim there; they all entered legally on tourist visas and never left. Not, I believe, a crime, although they are civilly subject to summary deportation.
What about accepting welfare monies, health care; etc which you would not be entitled unless you are a citizen?
They are a criminal the second they set foot in the US!
Is immigration covered by a federal law ? Is breaking federal law a crime ?
Definitely a crime. Probably several crimes, because that's not easy to do without using a false ID, making false statements on government forms, etc.

Sometimes yes, sometimes no. For example, most people who underpay their taxes have not committed a crime, but they have civilly violated the Internal Revenue Code. The immigration laws likewise include both civil and criminal violations.

Entry without inspection (smeaking across without presenting yourself to a border agent) is a crime.
Visa overstays (legal entry but then staying beyond visa limits) is a civil offense.
Fraudulent entry (fake identity, lying about status) is a criminal offense.
Breaking the law is only a crime when the law-abiding run afoul of the law.
