Any election that includes federal offices must abide by federal law, not state law. If there is a change in federal law, the states must change their laws to be in accordance with federal law.

The federal government passed laws regulating certain aspects of federal office elections after the fiasco in Florida between Bush/Gore. I was working with our state party in election law when those new federal laws came down. Instructions to election judges had to be rewritten and the process itself also changed so our state laws had to be rewritten to agree with federal law. We had new Federal Guidelines the state had to meet by certain dates and I was in the middle of that since I taught election judges. Had to redo my instructions to judges.

But the commission has no power (under Obama’s own executive order) to do anything other than release a report with recommendations. The recommendations (even if unconstitutional) have no effect unless or until Congress or the states enact them into laws.

Saying that 0 should be impeached because of recommendations this commission may or may not make, which may or may not be unconstitutional, and which have no legal weight, is nonsense. Worse, by calling for impeachment over stuff like this, you run the risk of a “boy who cried wolf” issue, where very real criticisms and serious calls for impeachment (say, over Benghazi) get ignored and/or lost in the noise of this type of thing.

He can put executive orders in action just as he did in the ones that re-wrote the rules of healhcare to include ways to keep people from being able to buy guns. He controls the rules to every executive system under him. He will change elections by himself - I am sure of it as I have seen him use rules to change anything he wants.

You can believe he can’t, but you will see.

The Constitution says that states can choose the method of selecting Electors. There are no federal requirements that the method must be via election. Like with selecting Senators prior to the 17th amendment, the states could decide to appoint Electors themselves, and be perfectly Constitutional.

In a presidential election, each party in a state chooses their electors in any manner they see fit. The Democrats have a set and the Republicans have a set in each state. The document that comes out of that meeting, is the official statement of the party of the outcome of the election. So, that is not a function of the federal government.

Could Hussein change that? There is no way to know what his thinking is about any part of elections. We don't know his purpose for setting up this commission but, knowing him, I suspect a bad outcome.

Article II Section I Clause 2


Each State shall appoint, in such Manner as the Legislature thereof may direct, a Number of Electors, equal to the whole Number of Senators and Representatives to which the State may be entitled in the Congress: but no Senator or Representative, or Person holding an Office of Trust or Profit under the United States, shall be appointed an Elector.

In a presidential election, each party in a state chooses their electors in any manner they see fit. The Democrats have a set and the Republicans have a set in each state. The way you describe is the way it is in the several states, but the Constitution is clear that it is the way because the legislatures established it to be that way. There is nothing preventing the legislatures from changing that to something else.

See the National Popular Vote movement as an example of another way being proposed. In the NPV movement, states form a compact that if enough states totaling 270 electoral votes join the compact, then all compacting states will give their electora votes to the winner of the national popular vote.

I am not in favor of the NPV alternative because I think it fails the compacts clause in the Constitution -- they need Congressional consent to form this compact. There is nothing to stop any single state from choosing to award its electoral votes to the winner of the national popular vote all by itself, without having other states do the same.

So state populare votes for electors can be changed if a state legislature can do it. It wouldn't be easy; the people of a state would have to elect assemblies and senates that would pass such a bill.

But the important thing is for states to remind the President that elections are state affairs, and the apparatus of the states can choose their methods. What if some states had their legislatures do away with presidential elections and instead choose their electoral college members directly, similary to how they used to choose Senators? It would be fascinating to see how this would play out against the federal Voting Rights Act of 1965, because it sidesteps voting altogether in a perfectly Constitutional way.

I see where you are coming from to be concerned about electors. You're thinking about doing away with the electoral college and using the national popular vote to elect the president.

The reason it was set up the way it is, is so large population states would not determine the outcome of the election by themselves and the lesser populated states wouldn't matter. Maybe Hussein wants to do away with the way it is now and go to the popular vote since he is more popular in cities than in rural areas. That is likely true for all Democrats. You know, it's a matter of those country folk with their Bibles and guns that are Republicans, so go with the popular vote and a Democrat president always wins the big cities.

Don't get me wrong. I understand all about the electoral college, how it empowers the smaller states, and how it contains vote fraud from spilling outside of large, populous states. This is just a thought exercise for me. I've been a long participant on the NPV threads as an opponent of it.

I merely bring it up to point out that the Constitution leaves it to the states to choose the method of selecting electors. I, in no way, endorse the NPV scheme.

I am, again as a thought exercise, pointing out that an equally extreme, but totally Constitutional, alternative would be for state legislatures to do away with presidential elections altogether and just appoint the electors themselves.

The question is, what would Obama's commission say about that? It would certainly do away with the long lines that Obama is complaining about! :-)

What would Holder say about disenfranchising people if there is no election at all to be disenfranchised from?

The truth is that Obama does not respect federalism, that is, that the states are sovereign governments in their own rights that coexist with the federal government. Obama sees the United States of America as really the United People of America. Obam sees the federal government as the controlling government in all things.

Obama cant order changes in the States,but the Commissions recommendations can be forwarded to Eric Holder at Justice and they can find Nice Left wing Judges appointed by the Marxist to file cases about so called abuses and the Judge will order the Changes to get all Democrats elected.

Wow. Hadn’t heard that.

But this makes no sense. Obama doesn’t have the authority to change election law like that. That would have to be passed by law, not by Exec Order.

Once the election commission makes the recommendations he wants, He will get laws written and passed or he will make RULES that will accomplish the same thing. He controls the rules of every executive department over him. There are now thousands of rules written for healthcare. A new IRS RULE is to gather “tax” for healthcare. Another new RULE IN HEALTHCARE is to give money to states so they will give private information on patients so Hussein's people can determine if they can have a gun. He is writing RULES for healthcare to prevent vets from getting guns. It's the RULES not the law.

If any federal election law we have now is rewritten or adjusted in some way, he will write new RULES. If he gets one new election law passed, he will write new RULES.

After the Florida election of Bush/Gore, the federal government wrote new election laws and every state had to change their laws to reflect those changes/new laws. That law outlawed punch cards. It gave money to any state that wanted to buy new electronic voting machines. It standardized the process for Provisional Ballots. It made every Secretary of State the head of voter lists to compile them so that the paperwork for every person who registers to vote now goes to the Secretary of State to be added to the official voter list.

Those are not the only changes, but that will give you an idea what had to be done after those federal election laws were passed.

Whatever comes out of that election commission will be used by Hussein to get what he wants, whether actually in the law or by the rules he writes to “carry out” that law. He has jerked around the healthcare law writing rules for it to prevent us to have guns. Use that for an example of what I expect to be the final outcome with this election commission - elections will be useless when Hussein gets through (that is my opinion).

That is the question of the day. I think that the growing class of those who have never been (and don't care to ever be) productive is reaching critical mass. That could mean the rest of us are not going to be much of a factor in future elections.

You are right. There is a verse in Daniel in the Old Testament and it refers to the evil one. That verse says he will think to change times and laws. Hussein has changed laws and I don't know yet what “times” means.

The fact this one man is being allowed to destroy the country leads me to believe this is Biblical.
