Any election that includes federal offices must abide by federal law, not state law. If there is a change in federal law, the states must change their laws to be in accordance with federal law.

The federal government passed laws regulating certain aspects of federal office elections after the fiasco in Florida between Bush/Gore. I was working with our state party in election law when those new federal laws came down. Instructions to election judges had to be rewritten and the process itself also changed so our state laws had to be rewritten to agree with federal law. We had new Federal Guidelines the state had to meet by certain dates and I was in the middle of that since I taught election judges. Had to redo my instructions to judges.

And many of the States are under communists Democratic control. They will accept whatever their leader wants.
