um... you need a plot AND at least one overt action, don’t you?

You can’t jail someone for saying ‘I’ll kill you’

You can’t even jail someone for saying “i’ll hire someone to kill you”

But once they say that AND hand over some money, then you have at least one overt action to the furtherance of the plot.

I am not a lawyer, I don’t even play one on TV...

She did more than say, “I’ll kill you.” She attempted to get someone to do it.

watch the TV shows where they nail some poor bastard for hiring a hit man- until he hands over the money they don’t arrest him.

they give him every opportunity to back out- up to that point.

According to the deposition, Williams' aunt decided to create a Facebook profile for a fictional man that she named Tre 'Topdog' Ellis...

For a "sting" like this to work, it must be believable. ;)

Doesn’t have to be money.

From the article the girl offered to have sex with the ‘boy’.

That could easily be considered ‘payment’ for the ‘hit’.

But, not all states consider conspiracy in and of itself as a crime. Most state and Federal law states that the persons involved need to exchange ‘goods or services’(money also) first before it reaches ‘criminal conspiracy’

But some states still hold that ‘conspiracy’ is still a crime, whether or not an ‘agreement’ has been tenured.

Not sure if the state she lives in does or not.

she talked to someone else about it but that is the agreement between two parties part of the definition, but not the overt act part.

“Federal statutes, and many state statutes, now require not only agreement and intent but also the commission of an Overt Act in furtherance of the agreement.”

I am not sure, since it says ‘many state[s]’ if it applies to her state

According to court records filed Tuesday, 19-year-old Marissa Williams has lived with her aunt in Fosters, Ala., since April 2014

She's an adult at 19. Should have kicked her out after the first week. Why did the aunt take her in in the first place? Seems the aunt should have known long before that the gal was a looser.
