As a practical matter, the constitution is quite gone.

As a legal matter, which drives the Left nuts, it still exists.

Article V specifically empowers the people to do that which we could not do in 1775.

Through this gift of the framers, we can avoid bloodshed, and peacefully correct our mistakes.

History will not look kindly on a people who gaff off their responsibility.

“Mark Levin begins “The Liberty Amendments” by saying he doesn’t believe the Constitution requires “modernization through amendments”. But he then proposes a series of amendments, six of which modernize our Constitution to delegate to the federal government most of the powers it has usurped during the last 100 years.”

he states that as fact

if this guy is not a paultard, he is in denial

after that, i decided the fool is not worth reading

States can offer reasons in their applications if they wish, but amendments are proposed and debated at the convention.

paultardism

“...today there are numerous agencies in the Executive Branch of the federal government. Where is the constitutional authority? “

where does the constitution establish someone to clean the toilets in the whitehouse?

Fellow Patriots,

It is exciting to see such a renewed interest in basic constitutional principles. Liberty lovers across America are studying their past in order to find ways to stop our federal government’s explosive growth and sprint towards socialism.

Fortunately, our Founding Fathers, with their thorough understanding of human nature, created constitutional means to restrain the federal government when it exceeded its jurisdiction. One specific means was the Constitution’s Article V amendment process by means of a Convention of the States. This is a proper solution.

We have not come to this conclusion lightly. Like many of our conservative friends, we initially avoided this constitutionally-specified process due to a fear of what might occur, or what could happen. But after years of research and studying the Founders’ original intent for this amendment process — and after years of witnessing an unconstitutional reshaping of our federal government — we are both confident that this is the correct course of action.

The Federalist Papers declare that the Constitution specifically furnishes each part of government “with constitutional arms” for its own “effectual powers of self-defense.” One such arm of self-defense that the Constitution gives to the states is an Article V Convention of States. For states to refuse to use this tool would be like going into a street fight, but refusing to use one of your biggest and most effective weapons. And it is illogical to consider the use of any constitutional provision as a threat to the Constitution. It makes as much sense as violating the free-market system to save it, or breaking health care to fix it.

We urge you to support all of the Constitution, and thus the efforts of the Convention of States to pass their extremely well-thought-out and strategic legislation in your home state and join us in a call to restore our constitutional republic.

God Bless,

“The federal government has no lawful authority to own national parks, grazing areas, forests, and such.”

then IF we accept this wackjob’z theory, why would adopting an amendment to protect private property offend him?

this fool is begging to feel important - and drive traffic to his little wordpress blog - he is exposing himself instead

you wouldn't be the author, wouldya?

“So! What should we do about non-citizens voting? Here is a novel idea: The States should man up and reclaim their powers retained by Art. I, §2, cl. 1; tell Eric Holder to take a hike; require all currently registered voters to provide proof of citizenship; and refuse to register new voters unless they provide proof of citizenship. Enforce the Constitution we have!”

adolescent game of ‘i wish’ and ‘if only’

the states ARE NOT doing that

what is this wackjob’z solution - aside from whining ‘the states outta...’ dreaming clap

more clap about dreaming of what states SHOULD do - and ignoring what they ARE doing

“So the States must man up and enforce that original intent. They must ignore – nullify – all pretended federal laws, regulations, and judicial opinions which are contrary to that original intent.”

“Conclusion
Levin’s amendments legalize – make constitutional – the very abuses they purport to correct, nullify the natural rights of the people, and fundamentally change the constitutional design.”

The author cites the very first sentence in Mr. Levin’s book and then critiques some of the amendments proposed by Levin.

Regarding those critiques, what specifically to you take issue with?

here is a hint for the militia nutz to use to attack levin

levin was a fierce opponent of a convention of the states - but changed his mind after researching it

try using that to discredit him

amendments are proposed and debated at the convention

Not according to Levin regarding the proposing. Amendments are proposed before the convention.

If they are proposed DURING the Article V, that is what WE have been griping about. Once the door close, they can propose anything. The Lib/Progressive/Dem/Leftists can also propose amendments.

As I posted in a previous post, this topic is ripe with misinformation and disinformation regarding what an Article V is and what is can and cannot do.

propose the repeal of gravity - who cares?

the states will NOT ratify that

if they do - then so be it

seems you don't know everything about this either

how many delegates from each state? how are they chosen - what if a state sends too many?

we are learning - seems you might need to also

and from my reading of levin, he says to CALL the convention, all the subjects of the calls (to congress) for a convention must be SIMILAR - i don't know where he gets that from - but he does not say everything must be set in stone before a convention is called

levin says yes - crap might come out of a convention - the states are hopefully smart enough not to ratify that crap - but this is our hail mary pass - nothing else is working

i am open to other solutions - just not opposed to this one going forward

Take a deep breath and look around. There are states exercising their sovereignty right now and others on the brink of it. Utah is getting ready to take back some of their land from the US govt, 9 states have refused to enact the national ID, about half the states refused to set up state exchanges for Commie Care, 13 states have legalized medical marijuana, and on and on. The ball has already started rolling. It takes awhile to build up momentum.

Soon you will see the states nullifying the EPA regulations for power plants. This party has just started. The next two years are going to be intense.
