The funding was already approved. The Federal mandate for installing that automated train safety technology required all railroads to have it in place by 2015. Philadelphia's system was scheduled for installation later this year, in anticipation of the December 15th deadline.

The Federal mandate was absolutely idiotic on a number of counts -- mainly the technological hurdles that needed to be addressed. Having Congress mandate this kind of thing (and we can thank that retarded jack@ss George W. Bush for signing it into law, as it was passed in 2008) is the equivalent of passing a law ordering NASA to send an astronaut to Jupiter within the next six months.

If the Philadelphia area was going to be the last stretch of the Northeast Corridor Line where the automated train control system would be installed, I can almost guarantee that the delays were related to a problem addressing technology compatibility issues between Amtrak's train control systems and the counterpart systems for Philadelphia's commuter railroad (SEPTA).

Comparing a train engineer to an airline pilot is ridiculous. How hard is it to “drive” a train?

Well we have 8 dead and 12 missing. I would say hard enough that his guy shouldn't have been doing it.

You know, the rest of us Taxpayers are going to pay the bills from the lawsuits of all those victims.

On that front, the lawsuits aren't likely to amount to as much as you think. Federal railroad law establishes a specific limit on the total liability a railroad may face in an incident like this. I believe the amount is fixed at $200 million, which sounds like a lot of money. But it's important to remember that this covers all claims related to a single incident, which means it is probably a fraction of what a defendant in a single case might face when dealing with multiple fatalities and dozens of seriously injured people. And because it's a fixed amount of total liability, all of the potential plaintiffs will be fighting among themselves to get their own share of that maximum $200 million award.

What in the H is smart track? Is this move to have the trains drive themselves?

The signals are there and plain to see even if it was his first time at the controls which I would wager it was not. The rail line that this train runs on is not an option. It is the same route over and over again so there is no reason except negligence, period.

The amount of money and technology in the signaling portion of the rail system is staggering, and it is not taken lightly at all. Just a proposal to get something changed in Signaling is tougher than getting the truth out of the IRS. Every railroad employee MUST attend and pass a FRA railway safety class every year and the class is a full day. Every railroad has their own training and certification system. I know, I have more fargin badges that qualifies me to be working on or near their tracks than I can keep up with. I have one for AMTRAK as well.

I would suggest reserving judgement on this particular point until you hear from someone who is actually an expert on Federal railroad law.

With all due respect to Judge Napolitano, I've learned over the years that a talking-head lawyer on TV is usually demonstrably unqualified when it comes to legal issues that involve specialized matters of law.

Gays on average have higher IQs and make more money than straights—I’m really not sure that any AA is required for them to be promoted.

Here’s a description of the requirements to become a train engineer—doesn’t sound that rigorous:

He also threw the emergency break on in the turn.

Probably would have lost it even at 50mph throwing the break on the way he did.

At the risk of appearing rude, what gay source did you pull that statement from? If they had half the intelligence God gave an earthworm, the gay community wouldn't have been awash in AIDS, and the only reason they appear to have more money is because they don't spend money raising children or paying thithing.

You don't need an abnormally high intelligence to be a train engineer. You need to be alert, methodical and disciplined. Psychological stability counts for more than intelligence. How do gays rate on that scale?

They also never went up to engineer through conductor. That was for ones wanting to get into administration. The engineer came from the engine crew which required two in the cab in case one passed out.

Where was the brakeman or backup engineer? Ain’t Marxism wonderful.
