The Second Amendment Is One Supreme Court Justice from Repeal

In August, my colleague Charlie Cooke wrote an epic rant daring the Left to stop talking about repealing the Second Amendment and start doing it. Introduce the repeal to Congress, work it through the states, and tell the American people what you want to do — take from them a fundamental, enumerated right from the Bill of Rights. As Charlie eloquently outlines, repealing the Second Amendment is an impossible task. Even worse for the Left, it’s political suicide.

But if the Supreme Court’s decision in Obergefell v. Hodges teaches us anything, it’s that the age of judicial supremacy means that five justices can amend the Constitution far more efficiently than Congress and the state legislatures. And right now there are clearly four Supreme Court justices who are committed to the absurd view that the operative clause of the Second Amendment — “the right of the people to keep and bear Arms, shall not be infringed” — doesn’t actually mean “the right of the people” and therefore doesn’t encompass an individual right to own a weapon, even for self-defense. This view defies history yet is received, conventional wisdom on the judicial Left, in much the same way that it’s received, conventional wisdom that the Constitution actually protects rights to abortion and gay marriage.

I really don't think liberals have any idea what kind of deadly havoc would ensue if SCOTUS was to repeal the 2nd Amendment.

You think 1865 was a bloody year for America?

Technically, the only way to repeal the 2nd Amendment is to get a new Amendment into the Constitution--that's how they repealed the 18th Amendment in 1933. Given how hard it is to ratify a new Amendment to the Constitution (look at the failure of the Equal Rights Amendment), good luck trying to repeal the 2nd Amendment through the Amendment process.

Perhaps I'm a bit thick this morning, but the last time I looked at the Constitution I didn't see where the Supreme Court had the authority to unilaterally repeal any part of it.

Or is this just National Review trying to be relevant?

The Supreme Court cannot repeal an inalienable Constitutional right.

The moonbats on the court might think they can, but they can’t.

You’re right. This article discusses ways and restrictions liberal laws could put in place to nullify the 2nd through restrictions on ammunition sales, etc. Basically making America a gun-free zone.

Liberals understand incremental politics. They boil the frog slowly, they would do it case by case over time as they have other issues. They would chip away at it, they know it they cant do it in one sudden repeal, but they know they can do it over time.

Rock n’ hard place time for constitutionalists. Assassination of “those giving the orders” to overturn our founding document will be preemptive self-defense. But most of us do not savor the feeling of evil that comes over us when we are forced to kill.

Even if they managed a handful of "takedowns" people would notice.

Scalia and Kennedy are both turning 80 next month. Thomas will be in his 70s during the next Presidential term. If Hillary gets to replace any one of them then a far left wing oligarchy of Supreme Court Justices will be dictating every aspect of our lives for the next 30 years.
