Evidence of what? At the time that DPD had contact with Kim, they thought all they had was a drunk in public case headed for the drunk tank. Why would they search Kim's car? They have to have probable cause to search somebody's car or perform it attendant to an arrest of the operator of the vehicle.

It is very common - in fact, normal - for police to have contact with all kinds of people throughout their day that they don't run for warrants or check on in any way. Such people would be complainants and witnesses to minor incidents. I'll give you an example: A woman hears yelling coming from a nearby residence or business. She's about to call the cops when she sees a cruiser coming half way down the block. She waves it over. She tells the cop it sounds like some trouble is going on in the dwelling. The cop investigates that, NOT the person who waved him over. He doesn't even get that person's name. He doesn't need it, and he certainly would not be able to search that person's house or vehicle parked in the driveway.

Since Mangum appeared to be passed out drunk and the driver of the car claimed not to know the woman who was drunk, there was no legal basis for a search nor a reason for a search, and no particular reason to even get Kim's name.

I don't know if the guard reported that to the police. I know she made the statement after the fact, however. i did not hear her say that during the numerous replays of the security guard's 9-1-1 call from Kroger's.

Kimberly blasting that the family member's saying that she was sodomized by a broom was junk because the cops never looked at the broom. Nifong should have been more prudent--has heard about mental health, forensics, priors--should find out that internal injuries were caused by players or who? Was there a mustache? Need someone to testify that they were in the bathroom with her or this case is a no go. Bob says he has to have more information--if there is tissue under the fingernail then that's powerful info that she scratched someone. Maybe she was assualted but it wasn't these guys. Evans looked credible. Keeping it a year doesn't help anybody. All of the info is quite exculpatory, bookended by outside influences--neighbor and taxi driver + mustache. Is it possible that DA doesn't have any more evidence?? Yes, he was up for re-election. Pressure from black community to pursue this case. Leaves it up to grand jury (spare me). Nifong made alot of statements--had goods and is going to ride it to hog heaven, but he has stepped in it. Usually want a case to go forward because sexually assualted sometimes back out. Unlikely that anyone else will say they were in there. Kim saying that Colin is the only one not looking strong. He may have some issues. Sean: should he have to prove that he is innocent with receipts when he didn't do anything.

When you listen to Kim's speech during the 9-1-1 call she made alleging the racial slurs from the "frat house" when they drove/walked/sat by the house, she didn't sound drunk at all. When the cops came, if she kept her distance from them of a few feet, no way would they think she'd been drinking, especially if she freshened her breath with something while waiting for the cops to get there. They were there to deal with Mangum and their understanding was that kim was just a good samaritan who gave a drunk woman on foot a ride to a safe place. All the cop wanted to do was clear the call.

Sean is going now.

1. Discussing the DNA material being on top of the nail. Says it was "reported" does not say where. Badden is BSing.

2. Badden says the do not test for evidence of condoms in rape cases.

3.Discussing the missing moustache with Kendall. He reads from the ID of Evans and says how weak it is. She says it is not tissue on/under nail.

4. Kendall says discusses her bruises on her will dancing. Speculates the SANE may have been mislead.

5. Kendall and Sean discussing her inconsistent statements. No broom sought. Says the claim of 20 has been somewhat debunked.

6. Sean asking about cab driver arrest and delay of a year. Another woman, Kimberly, is criticizing Nifong. Dreaming of a secret witness to make the case.

7. Badden says case is weak, talking about tissue again.

8. Talks of assuming the DA has something else. Kendall defending Nifong due to having a woman claiming a rape and a SANE report. Kimberly says he thought he had a case and stepped in it.

9. Sean and Kimberly doubting they have a player turned. Kimberly doubting the Finnerty because he has been quiet? Kendall saying is not right, but it will become a swearing contest.

10. Sean ask about Nifong refusing to hear all the evidence. Kendall says it is shocking. Kimberly agrees and says the men can be the victim if they were falsely accused. Mentioning his role is to seek justice.

11. Sean asks about the petition for her cell phone records. Kendall says they will get it. Kimberly says they are trying to get the discovery quickly and the DA is dragging his feet.

12. Asks why we have not heard more about Finnety. Kendall says they just don't talk. A matter of policy.

Kim: Nifong in over his head because he didn't give exculpatory evidence to GJ. Reede's attorney's filing motions for stuff they can already get. DA's office sets the docket. They want it faster. Colin's lawyer's say that they do not talk. It doesn't do their client any good.

My impression was that at least one of the girls knew the guard at Kroger and that's why she drove there instead of the hospital or PD where she would be detained for information.

In our area, many guards are retired cops. From what I read of the phone calls, there were three people involved in the phone calls.; the guard and two cops.

Have we EVER heard the name of the guard?

If she DOES have a 12 year old kid, the announcement to hubby-to-be may have necessitated some diversion from the actual facts about pregnancy and the kid, and the rape story might have been invented to mollify him about it in a more palatable (to him) way........just what-iffing here....

She was saying that last night. The only thing is, the ONLY thing we know that they have on him is the ID. If the ID on the other two turns out to be bogus, how could anyone in their right mind believe any ID from CM?

He doesn't need to prove his innocence. He just needs to show that CM can't be trusted with an ID.

Kimberly says they are trying to get the discovery quickly and the DA is dragging his feet.

I am thinking he is waiting for a judge to be assigned. Then he will petition for a gag order. That way when the discovery is given, the defense will not be able to make it public.

Nifong does not care that the defense knows they are innocent, he just doesn't want everyone else to know.

1984. Durham police pull over the car in which I am a passenger. Guy had 2 beers, I had had probably 6 or 7. One long block to east campus at about 3am. Cop does drunk test (not breath) on guy. He can't walk the line. Asks me why I wasn't driving--I say "Not my car" He tells me to drive back to campus and lets us go. I drive through the gates and return car to guy. Durham's finest detecting intoxication.
