Old Man Says Cop Beat Him for Trying to Help

Fairhope, Ala. (CN) - A police officer beat an elderly man who called 911 to report an accident and stop a drunken driver from leaving the scene of a crime, according to a complaint in Baldwin County Court.

Dorsey Henderson says he investigated an auto accident that happened across the street from his house. After determining that one of the drivers was belligerently intoxicated, he told the man not to leave and called the police.

When Officer Trent Scott arrived on the scene, Henderson tried to tell him what had happened and that he had put the driver under "citizen's arrest" because he was trying to leave. Officer Scott told Henderson there is "no such thing as citizen's arrest in Alabama," adding "get out of the way[,] old man."

While citizen's arrest is a gray area in Alabama, Henderson says he had "only been trying to help."

Nevertheless, Scott put him in an arm bar, tearing the man's rotator cuff, and walked him across the street.

When they were back in Henderson's driveway, Scott "slammed" the elderly man face first into the driveway, breaking his nose and his glasses. Scott "proceeded to beat" Henderson in "the back of the head, neck and arms." Scott did not arrest Henderson or charge him with any crime.

Henderson's wife, Dorris, watched from a wheelchair 18 feet away and called 911, saying that Scott was "beating the hell out of my husband." When the ambulance arrived, Scott sent it away, handcuffed the man and put him in the back of his patrol car.

Scott's superior showed up, released Henderson and called the ambulance back to treat Henderson and bring him to Thomas Hospital.

As of May 16, 2011, Officer Trent Scott was still employed by the Fairhope Police Department.

Henderson and his wife seek damages for constitutional violations. They are represented D. Keith Landers of Daphne, Ala.

Is anyone running a “questionable cops” and “raids gone bad” ping list?

I tried to start one but Jim Robinson flung a hissy said posts like this one are nothing more than spam...

Every time I post such a story it gets booted to the chat section and my account ends up in moderation for a few days...

Police spokesman said the cops vehicle camera recorded the entire incident. If true, that will settle things. But I would think the attorney representing the plaintiff would have viewed the video and advised his client to NOT file charges, if the lawyer is HONEST and the cop did nothing wrong. BE interesting to see the outcome of this.

Naturally the cops have released their version of events.

Which are contradictory. They claim "absolutely no abuse" but then say in the same breath that the accused officer was the one who called for medical assistance to Henderson. If there was no abuse, exactly how did Henderson get in such a way that immediate emergency medical care was somehow needed?

And do they have motorized camera mounts in the car that track the officer's movements? The beat down allegedly took place in Henderson's driveway yet they say that the camera in the squad car exonerates their hero. Did the camera somehow show Henderson tearing his own rotator cuff, smashing his own face into the driveway and bruising himself on the neck, head and back or did some other thugs come by? How do they dismiss the 911 call by Henderson's incapacitated wife? If a orderly LEO is on the scene, why call 911 again to report a beat-down?

In view of the Indiana Supreme Court's decision that somehow illegal B&E by rogue officers can be remedied in court - it is pretty damned obvious that there is no justice and that the officer's employers are highly motivated to perjure themselves and blame the vic in their kangaroo courts

You right, maybe that's what we need to do is group up, spread these stories around amongst us all and then have a ping list.

I bet she'd of died the same way that Marine did in AZ recently, in a hail of 71 rounds then left to bleed out as EMS was held from the scene for over 1 hour.

I grew up in a little WV town. A couple times a year I return to visit parents & other family that still live there. One of the things that I have noticed that a couple of teen hoodlums that I knew when I was a teen are now the town cops. I know its a small town and can't pay decent salaries for city employees, but unless these guys really really matured, it a tragedy waiting to happen. I wouldn't have trusted those guys with a burnt match let alone a firearm and the power of life & death!

Wonder if this was a State Police Officer or a local-yokel. For some reason it often seems that the local police frequently consists of a different quality - not saying they are all bad because they aren’t but sometimes the local ones are on a power trip passed down from family cop to family cop.

Never—never, mention citizen’s arrest to a cop.

Nothing riles a cop up like having the citizenry do their job for them. They immediately think Vigilante’s and realise that if Vigilantes do their job, they won’t be needed.

They go pschycho, when a citizen does their job.

Yeah, that’s the ticket.

Stinking Badgestard needs to be locked up reckless endangerment at the VERY least. When he dismissed the ambulance, he was actively preventing Mr. Henderson from receiving medical care for his injuries which could very well have proven to be fatal.
