Cain's lawyer demands records from accuser

ATLANTA (AP) - An attorney for Republican presidential candidate Herman Cain has demanded cell phone records from an Atlanta businesswoman accusing Cain of an extramarital affair.

Cain attorney Lin Wood sent a letter Wednesday to a lawyer representing Ginger White asking that Cain's team be provided with cell phone records showing calls and text messages between White and Cain.

If the process is as I understand it, and bringing action against this woman entitles her to a treasure trove of “discovery,” this move on Cain’s part would seem to indicate he has nothing to fear and may indeed be innocent.

Brilliant strategy actually. Cain’s lawyer demands the info, she refuses to comply. Cain’s lawyer files a civil suit against her, she has to respond, and, therefore, obtain representation to defend against the lawsuit.

That’s the key. Who will represent her (someone will), and who’s going to be paying for that representation as she obviously cannot.

Yes, but he needs to get this behind him. If he can quickly show that this is blatantly false and he was just being benevolent, that is a win-win for him.

I just don’t think it’s that smart to play this as, “Let’s see what you have, and then I’ll come up with a response.” You’re on defense when you handle it that way.

If you had some bimbo accusing you of infidelity, would you tell your wife, “Well, let’s see if she can prove it,” if you could easily disprove it?

I just don’t think it’s a smart tactic at this point.

She was probably hoping that Cain would freak out when the reporter first texted Cain, and that Cain would offer her a ton of money to keep quiet. That didn't happen, so the report aired.

Why would she not call Cain first, and tell him that she had been hounded by reporters, and that she intended to talk to the reporters? Why would she let the reporter blind-side Cain by texting Cain... leading Cain into a trap?

Why would anyone do that to someone they claimed to be having a “lover's affair” with for 13 years. Or was it “13-14 years”? Or was it “off and on for 11 or so years”? Her story has already changed three times.

She has no photos, no cards/letters, no receipts, nothing to show from a 13-year affair. I still have photos and cards from a an Ex of mine that was only a 5-yr relationship, and it ended 5 years ago. She claims to have messed around with him for 13 years, and that only the PHYSICAL side of it ended 8 months ago, yet she has NOTHING to show from it? No way.

Blackmail. Pure and simple.

The Primaries are only a month away. When any candidate has slipped that far and that fast in the polls as Cain has. It will not only take a miracle for him to recover, it will take a resurrection.

Don’t you think that you are being a bit ridiculous if you think that one can sue for slander without providing tangible evidence?

After all, a libel lawsuit, like any other lawsuit, is a process. There are certain steps to be taken before filing with the court.

Mr. Cain’s lawyer IS gathering evidence for a libel suit. Part of that process involves collecting evidence from Cain’s accuser—such as her emails and text messages.

It’s as simple as that.

However, the Primaries will be long over with by the time the court gets around to hearing the case and “deposing” her.

Damage done; mission accomplished. Thank you Lame Stream Media.

I can't wait to watch Piers try to interrupt Lin Wood anytime Wood makes a damaging point. That's what Piers did to Niger Innis in this interview.

Piers starts out by saying about Cain's campaign: “When he's saying to his supporters that he's going to reassess, it's over, isn't it?”

In the second clip, the woman disagrees with Niger Innis's premise and says that these kinds of allegations aren't happening towards Michelle Bachmann, another Tea Party Conservative. Well duh! Bachmann wasn't leading the race, so she didn't NEED to be taken down. Bachmann was no threat. What a maroon.

So you don't know squat about the American legal system, do you.

This is under Civil Law, which is a preponderance of evidence. In other words, she is the plaintiff and Cain is the respondent. Which therefore places the burden of proof on Cain. That is, if this were actually a filed case. Which it is not. In addition to that, if this woman was out for extortion, she would not have made it public. So, money is not her motive. The consensus is, that she was notified that this anonymous affair between her and Cain had been discovered by the press, so she came forward voluntarily to protect her own interests.

In essence, she has already presented the details of the case first, with tentative evidence to support her claim. (Text messages) All they have from Cain is an informal denial. That is hardly an admission of innocence to any court, so the burden of proof is on Cain, which he cannot yet refute.

This is just getting started. And with just one month away until the primaries, Cain has no chance.

Forgive me but regarding a lawsuit for slander, you don’t know what you are talking about. It’s so easy to tell other people what to do, not so easy to do it.

It’s this little detail of a legal education and experience.

So let me see if I understand you correctly. You think Cain didn’t handle this well. You think Cain and his attorney are slow on the uptake (”About time.”) to react and do this. But you also think it won’t prove anything.

So then why do you say “About time.” ?? If it’s not going to prove anything, then why do it at all?

And I’m assuming that even when Cain’s lawyer proves that this was all an attempt to blackmail Cain, you will refuse to believe that, because you have already determined that Cain:

A. Is guilty.

B. Doesn’t handle things right.

C. Isn’t fit to be President because of A and B.

Do I have it all correct?

No, it doesn't ~ remember, the burden of proof is on the accuser. Assume for a moment Cain is totally innocent of any sin in this. He wouldn't have records pointing toward sin, right?

She claims all the records reflect lots of sin time with her.

We all need to see those records and she should make them public or David Axelrod should retire to a monestary in Russia or someplace.

There is no legal case at present therefore analogies to a legal case are pointless.

A lawsuit can take years and would result in Cain being deposed on a wide variety of subjects and being forced to turn over all kinds of records. It is not a panacea.

The people on here who constantly insist someone should “simply” go to court are the types who get hauled out of courtrooms and thrown in jail for contempt bc they cannot fathom that the legal system isn’t there to do everything they want. These folks drive their lawyers crazy bc they discover all the court rules apply to them too, and that is just outrageous.

Agree to disagree.

Lin Wood is the expert in his field, not me.

Wood has said CAIN needs to focus on his family and his campaign. Dealing with this trash in a court of law can come at some point down the road. There is a finite time between now and Iowa. Court can wait for Cain, the Campaign and the voting dates cannot.

Lin Wood, on the other hand, can be busy behind the scenes doing his job, which he is obviously doing. Legal action does take time though. Lin Wood has said he believes Cain. People will either have to believe Cain for the time being, until this can all get settled by attorneys, or they can vote for someone else. That's what it boils down to. Because the timeline on the elections is cast in stone. Allegations cannot be controlled, and there could be one every week from now through March. Allegations are not facts. No facts have been presented of any affair.

Again, you clearly disagree. That is your right, and I respect your right to disagree.
