Man ordered to remove 72-ft boat from yard

NEWPORT BEACH, Calif., A California man who has spent the past six years restoring a 72-foot ship in his yard said the city is ordering him to get rid of the boat.

Dennis Holland, who has been restoring the Shawnee, a 1916 ketch, at his Newport Beach home, said city officials obtained a court injunction giving him until April 30 to get rid of the vessel, the Los Angeles Times reported Monday.

Deputy City Attorney Kyle Rowen said Holland faces fines of up to $1,000 per day or possible jail time if he does not comply with the injunction, which was issued Thursday by Superior Court Judge Gregory Munoz.

Holland is accused of not abiding by an ordinance requiring him to obtain a permit. He said officials would not grant him a permit because he could not give them an estimated date of completion.

"Mr. Holland has been in violation of city laws for many years and has had ample opportunity to move the boat to a suitable location," City Attorney Aaron Harp wrote in an email Friday. "The city is hopeful that Mr. Holland will comply with the court order and move the boat to a suitable location that is consistent with applicable laws."

Holland said the ordinance he is accused of violating was passed in 2009 and he did not break any laws when he originally began the project.

"I can't move the boat," Holland said Friday. "The city's going to have to come in and destroy it. I don't have the heart to."

Yeah, this gentleman is in Newport. Over by the Back Bay area. Post #53 gives an aerial of his place.
From the looks of it, I'd say he's been there quite a long time. The "McMansions" have sprung up around him.

I was thinking he might be over off of Superior Ave. But no, he's definitely in NPB city.

To bad he can't get one of the 'Sea Scout' groups interested in taking this over. They have done some neat building projects. Maybe one of the groups in HB or Dana Point.

I was born and raised in Newport Beach, there’s lots of places that look like that...

When I was kid there was a guy down the street, I think on Santa Ana Blvd, maybe, who spent many years building a huge boat like that...when it came time to move it to the harbor the city had to take down a bunch of power lines, that was cool to see!

“This looks more like Costa Mesa, its right next to Newport Beach. I don’t know of any section of NB that looks like that.”

Get a map, go there and look at the part NB west of Newport Blvd, extending west to the bluffs, and northward to past 19th St. It is mixed zoning with residential and commercial, including boat building, etc.

I seriously doubt your read on this issue, counselor.

If what he is doing is not allowed, he has no permit, he’s sol.

I have been in his predicament.... you cannot pass a law and enforce it retroactively... now if he was smart he would get that permit, if they denied the permit, his case would be so much stronger..
