SD Mother Wins Nutella Lawsuit

Marketing Nutella as “healthy” was deceptive, woman claimed

A San Diego woman who claimed Nutella deceived consumers by marketing their product as “healthy” won a class-action lawsuit on Friday.

Athena Hohenberg filed the lawsuit against Ferrero USA, Inc. – the makers of the chocolaty hazelnut spread – last February.

Hohenberg said she learned through the grapevine what ingredients where actually in Nutella. She was surprised that the nutritional value in the spread "was the next best thing to a candy bar," read her complaint.

At the time, Hohenberg was serving the spread to her four-year-old daughter, and didn't realize the product contained about 70 percent saturated fat and processed sugar by weight.

Advertising deceptively showed a mother feeding the spread over fruit and bread to "happy, healthy children." Ferrero USA, Inc. settled for $3.05 million in the California Southern District Court. The money will be distributed to people who purchased Nutella in California between August 1, 2009 and January 23, 2012 – or in any other state between January 1, 2008 and February 3, 2012. The iconic Nutella jar will look a little different after this settlement. Nutella can no longer call itself "An example of a tasty yet balanced breakfast," as it has on its back panel for years.

The grapevine? Could she not read the label or taste it? Nutella is nothing but the soft inside of truffles. Chocolate and the hazelnut version of peanut butter.

If it is that bad, she just shouldn’t buy it! What are the real economic damages possible for one jar of the stuff ... $5.00? If she bought more than one jar she should be deemed to be stupid and introduced to Slow Joe.

I butter just about everything that requires a spread,and I’ve never eaten Nutella.

My jar lists the ingredients and nutritional info. No artificial preservatives, lots of sugar, some protein, the rest isn’t worth mentioning. I didn’t see the word “healthy” on the label, only the phrase “This is what a balanced breakfast looks like” with a picture of Nutella on bread and various fruit. This tiny presentation is on the back and unlikely to convince anyone in the grocery store to purchase it for health reasons. You buy it because hazelnut chocolate tastes good.

I don’t even waste it on bread; it’s s great pre-made frosting. Much better than actual canned frosting which tastes like flavored preservatives..

It does taste close to a ganache. That being said, heat some in the micro and pour it over ice cream. Very good. And no... it isn’t “good” for you. It simply tastes good.

I thought chocolate was proved to be healthy because of the antioxidants in it?
When her kid gets cancer she can sue her mother for taking her medicine away.

Put a tablespoon in a wonton wrapper, fry it for a minute or so, dust it with some powdered sugar. Makes a quick, fun dessert. It’s my daughters’ favorite treat when they have sleepovers. But, because it has never occurred to me that Nutella may even be remotely healthful, I only make it on special occasions. This woman couldn’t read a label?

Are you kidding? I *love* butter! Butter is one of the four major food groups (along with steak, candy bars, and beer).

Nutella is tasty too; you should try it.
