but it may not have been an accident.

From the article:

Bishop James Dixon, Scott’s pastor, said of the encounter, "There was a car accident and they pulled over into the Shell station to talk about it."

There was an accident, it's in the first sentence of the story:

"Houston area investigators are looking into a stand-your-ground case where after a minor fender-bender..."

So they were both required to exchange information, which would be pretty hard to do locked in your vehicle with the windows rolled up.

If in fact he did pull on the handle, it wasn't to enter the vehicle but to get the insurance information from her -- and she knew that.

Did she? Again, read the law. If she felt threatened then she was justified in shooting him in self defense. He didn't need to even open the door. All the law requires is that she believe he was about to illegally attempt to enter her car. After that any force she used to protect herself or her car is presumed to be justified.

“Don’t Texas cops accept these ‘SYG’ on nothing more than the claims of the shooters anyway?”

No, I believe if there is any dispute at all as to the situation, it has to go to a grand jury, just like anywhere else, which is what is happening in this case.

Writer’s description ~ we don’t have a police report there. That’ll show up eventually ~ as they always do.

Is this her way of "talking about it"???

She was packing that day ~ must be a tough commute for her ~ I’d guess the bank is a high risk area.

I have no idea what the truth is and what her situation is. I'm waiting for the dust to settle and for facts to come out.

However, one article states she was a previous victim of a road rage incident, after which she bought a handgun and got a concealed carry permit.

At no point have I said this woman had a right to shoot the victim.

I'm just stunned at how quickly she's been convicted on FR based on these news reports. We all know how incomplete first reports are. We have eyewitness testimony that is apparently inconsistent in some way. A number of the comments here have a racial overtone.

I'm convinced that, if the shooter had been a white woman had claimed that a black man had grabbed her door handled, pounded on her window, and tried to open her door after the accident, this article either wouldn't have been posted or would have died after two or three responses.

A permit to carry is a permit to carry into any legal location. Why should she only have been able to take her pistol if she was going to a high crime area? Would you follow a similar restriction?

So? Her preacher is just yapping. What do the trained incident investigators say about it ~ it ain’t over ‘til it’s over.

None of the statements indicate he was able to gain entrance. . . . This does not appear to rise to the standard of the use of deadly force under any stand your ground or castle doctrine.

Sorry. Texas law covers attempting to enter a vehicle. You don't have to gain entrance to the vehicle.

Again, I'm not excusing this woman.

I think people need to go back to whatever they were doing before this article was posted, and wait for the video and more information before they reach a judgment in this incident.

The story takes place in Texas. People are free to carry guns there ~ she didn't need any particular reason and that wasn't my point. She took her gun with her. People who work at bans in this area frequently carry guns. With our location near a really major interstate highway intersection we have more than our fair share of bankrobberies and daring daylight hijackings in parking lots.

One FReeper above says she'd been carjacked before which is when she got her gun. Guess it was deja vu all over again ~ and just his bad luck.

His "yapping" came from her.

Folks simply want all the SYG situations to be the easy ones ~ not the hard ones.

Lol, we don’t have a lot of things here, so of course we are going off the writer’s description. In this article, and every other one about the story, there is no question that there actually was an accident. You’re grasping at straws.

let's leave that determination to the examiners and investigators. You and others, including the writer, and even the victim, are assuming it was an accident because they are taught to believe these incidents on the highways are virtually always accidents, but sometimes they're not.

We need the arrest records, driving records, that sort of thing ~ and the final determination of the insurance companies and the cops.

You don’t even know that he attempted to gain entry.

Sometimes, certain FReepers are just so caught up worrying about how a certain conclusion might look to leftists, as if any conclusion of any FReeper would meet with their approval. You’re doing the same thing you believe yourself to be condemning, but worse. You’re taking the opposite side out of kneejerk emotion. The few known facts here do not appear to be all that favorable to a stand your ground shooting in self defense. You know that.

I suggest you try to put race out of the picture and learn to be objectively impartial. It appears you have issues in this regard.

I read that too.

How can they give this lady tickets on the first two charges.....without seeing the violations in person?

Unless I guess....they have traffic camera's.
