Couple Faces Jail Time for Saving Baby Deer’s Life

An Indiana couple is facing up to 60 days in jail and $2,000 in fines for saving a deer from death. Jeff Counceller, a police officer, and his wife Jennifer spotted an injured baby deer on their neighbor’s porch. Instead of turning a blind eye to the dying fawn, the Councellers took the deer in and nursed it back to health.

They kept the deer, Little Orphan Dani, in their backyard as it recovered. Everything was fine until an Indiana Conservation Officer spotted Little Orphan Dani in the Councellers’ yard. The Councellers were charged with unlawful possession of a deer, a misdemeanor offense.

The day that Little Orphan Dani was to be euthanized by the Conservation Agency, the deer inexplicably escaped into the wild. Although Little Orphan Dani was able to get away, the Councellers may not be so lucky.

Historically, crimes have two elements: (1) actus reus (bad act), and (2) mens rea (bad intent).

Most people would agree that nursing an animal back to health is not a “bad act” in the sense of being morally blameworthy. Keeping the deer is deemed to be a “bad act” only because the legislature has said it is prohibited. Do we as a society want to punish acts that are not inherently wrong with criminal penalties?

As a Pennsylvanian,I say good! I wouldn’t give these folks jail time, but I hope they have to pay a nice, hefty fine. The overpopulation of deer here in the Philadelphia area has turned deer into a menace. They cause car accidents, they annhilate gardens, rip up expensive landscaping, and spread lime disease. As far as I’m concerned, the right thing to do if you find an injured deer in your yard (baby or not) is to shoot it. If local ordinance forbids that, contact animal control to do it for you.

So, hunt them, cook them, and eat more of them!

The reason there are so many nowadays is because of idiot laws- their were LESS deer 20 years ago because there were less restrictions on hunting them

Well, no one's ever accused me of being smart and I suppose I am heartless when it comes to deer.

You would be too if you lived in southeastern PA where packs of deer roam the streets like the Crips and the Bloods.

As an Ohioan, I say good! I agree with the fine. Just because they look like Bambi, doesn't mean that they don't do severe damage to yards, cause car accidents, crap all over yards, etc. Their herds should be culled dramatically and the meat turned over to charitable groups.

Their overpopulation around here is a serious problem.

I'll bet you don't have deer in your yard. And I'll bet that they don't challenge your right to get in your car. I'll also bet they haven't stomped a pet or chased it to your door. I'll even bet that they haven't eaten 100's of dollars worth of plants either.

In ONE day we had a deer charge a guy on a motorcycle at one end of our drive and a deer run into the side of a van at the other end of our drive. The motorcyclist lived.

Yes I DO have deer in my yard(Front and Back)! Any YES I hunt them as well(Legally).

So glad to hear this.

It really made me think of Jesus saying if an animal falls into a pit on the sabbath which of you would not pull him out, meaning the Pharisees ill use of the law, basically because of their hard hearts.

The law is made to serve man, not man to serve the law.
