LOGAN, W.Va. (WSAZ) -- A woman is trying to put her life back together after returning home to an empty house.
Nikki Bailey got home from visiting her best friend in the hospital just in time to see the repossession company leaving.
“I was ready to rip out an IV and leave that hospital,” Pat Fot, Bailey’s best friend, said.
Fot knows Bailey makes her house payments.
“Everything was gone,” Bailey said. “Living room furniture, my Marshall diploma, my high school diploma, my pictures -- my history. I was teacher of the year. All of that stuff is gone -- certificates from that. It's all gone.”
As it turns out, the company had the wrong house.
The repossession company was told to remove everything from the house on Godby Heights in Logan. Bailey lives on Godby Street. Godby Heights is in Chapmanville.
“It just seems kind of ridiculous that this actually happened when a phone call could have stopped it,” Attorney Tim DiPiero said.

This happens all the time. Not long ago I read about it happening and the police refused to do anything about it.
When bankers do this then it is just called a mistake. You don’t even get your stuff back.
One of the little fiefdoms who call themselves ‘homeowner’s associations’ in Houston did that to an elderly lady here.
She got rich on the settlement.
well, both are bad, but this was a stupid mistake, but clearly NOT intentional. Last time I checked, most break ins were intentional.

I have a friend that owns a Home Repo company in the South Chicago area.
If you ever see some of the nightmares they are dealing with on a daily basis, you’d have a MUCH different opinion.
That said, the company does have an obligation to make sure it’s the right friggin’ house.
You are expecting to find a trash house and you see a real home. How stupid, how negligent can you be if that doesn’t make you stop and do a double check.

There already are laws against this activity. This is burglary and theft plain and simple.
No unfortunately according to the law. There is no criminal intent; negligence does not rise to that level. It is a tort, remedied in a civil proceeding. There have been many threads on FR for the same “crime” that happens all the time.

What bothers me is when I work for a bank headed by a CEO that's been driving the bank into the ground for the last 5 years and still gets his multi-million dollar raise and bonus each year - while those of us in the trenches trying to save the bank get neither a raise nor bonus -- some for several years in a row.
Yeah, this "over-compensating crappy CEO's" bullshit has got to stop.
Bet your CEO has lots of good friends in D.C.
My Metra train passes through the south end of Chi(t)cago to and from work every day. It looks like a warzone so color me surprised that anyone would actually repo those broken down, burned out pieces of sh*t called "houses" in that part of Chicago.
I'm shocked. I wouldn't get caught dead in those neighborhoods.
The current President is a client of the bank. He got his sweetheart mortgage through the bank I work for.
I'm sure our CEO has friends all over DC and in the Federal Reserve for that matter. We just hired one of the Chicago Fed Reserve guys at the bank. We (the bank) probably have connections that would make me nervous in DC.
Don't blame me, I have a job interview tomorrow morning. I've been trying to get OUT of that place for 2 years now. It's very difficult finding positions like mine at the salary I make. Especially at my age.

I can’t see why these “errors” aren’t prosecuted as burglary, at the very least. These people broke and entered and stole a massive amount of property.

There should be a requirement of significant advance notice being attached to the front of the target house, so the actual owner/residents have a chance to correct an error.

OMG! I can believe this news in our country today and the responses of the Bank, the Police, and the Attorney Generals Office. WTF! Apparently people will have to guard their belongings a little more diligently from here on out. I DARE any Repo People to come to my house. I Dare them. I think it is time We in America do something as our forefathers did to take our country back. I really want to know who this /bank & repo people are. I hope they Rot in heck!
