The Lee County deputy approached the parked van and told Torockio he was under arrest, but the upset driver simply said, "I am not! Don't you have anything better to do?" The septuagenarian continued to resist arrest while yelling and screaming, "What are you going to do, beat up a 72-year-old man?" When another officer arrived, Torockio was arrested and charged with resisting an officer without violence, failure to obey police and violation of county park rules. His van was later towed.

I thought the title of the original post read differently.
Now that I read the article, his arrest is appropriate.
He was holding everyone else up for his precious parking spot.
He was asked by and officer to move along.
He was bound and determined to get his way, with no regard for the effects of his asinine and obstinant decision .
He dissed a cop and then used his age as a foil to evade arrest?
FK him and every other Jack wagon like him.
I hate lurkers.
Go find a friggin parking spot already and get some exercise.
I roll into a parking lot and take the first one I find, on the far side of the wparking lot.
Hell, I drive to the top of parking garages and call it a day.
I save more time just parking and getting it out of the way.
That old man is a self serving jerk, with Jo regard for anyone else’s time.
Yeah. Disorderly Conduct. When they can’t figure out what to arrest you for, it’s a DisCon for you and you’re in cuffs. Doesn’t matter what you were actually doing, but it allows the cop to be judge and jury all at once, and he loves the power.
Oh, you get a record. They get prints and DNA. And a good laugh at your expense, you silly little person (and they wonder why we’re coming to hate them?).
Add one letter and it says “Uninformed officer”.
Good for the cops. I get damned irritated at thoughtless, selfish drivers who, thinking of nobody but themselves, hinder traffic flow.
Lot of folks are like this jerk. They don’t care who they inconvenience as long as they get what they want.
I hate it when someone lets someone out and he goes across two lanes of traffic. I was in the left turn lane one day and two drivers in the other two lanes waived a guy through and he rammed me.
Another thing that usually happens is I catch the red light. It’s rude to everyone behind them.
Show me the Constitutional right to sit in traffic and block everyone else. Too many people drive like they own the world. I for one am tired of people in parking lots and such just sitting there waiting for that ideal parking spot, and making everyone behind them sit and wait too.
Can’t even be nice to people and let them out any more. Let someone out of a turning lane in front of me today. He thanked me by stopping and waiting in TRAFFIC to shoot three lanes over to turn right.
I’m usually not pro cop, but this guy had his chance to behave right and chose to pretend the world revolved around him.
“Simple solution. Direct traffic so that the person in the parked car gets out, the old man gets in, and everyone goes about their business.”
And reward his bad behavior? No. He needs to learn it isn’t about HIM.
“I want to be on a jury for a guy charged with resisting an officer without violence and failure to obey police. I want it so bad.”
He was given a perfectly lawful order to stop blocking traffic and refused. That is the very definition of resisting an officer without violence.
Usually I’m not pro cop, but this guy acted like a self centered jerk to everyone else. What would you have the cop do? “Pretty please with sugar on top?” Or perhaps the cop should cater to his ego and force someone to get out of this very important person’s way. After all, the world revolves around this old jerk.
I’m with the cop on this one. The guy was in the wrong for any number of reasons.

I don’t think you would get a ticket if you were blocking traffic while actively backing into a parking space. That is how they designed the road, and everybody just has to live with it and chill out.
This guy got a ticket because he was sitting there WAITING for a space, blocking traffic, and refused the request to move.
thats nuts! he decided to just stop in a moving lane and wait for someone to leave?,god,if anyone tried to pull that stunt in the tougher neighborhoods of New York,can u just imagine how the pissed off drivers would react?,although it does happen here on our main streets(many our tourist attractions of Naples),there is only 2 lanes and tourists will pull the same stunt here!
I don’t recall making the argument that the old man was 100% in the right, however, “failure to obey” is a charge certain to be misused.
And one day, it will likely be used against Freepers.
