S Tx families sue state agency over denial of birth certificates

''SAN ANTONIO - A group of South Texas parents say they are being denied their children's birth certificates.

The allegation from 17 families has resulted in a lawsuit against the Texas Department of State Health Services filed by the Texas Rio Grande Legal Aide and the South Texas Civil Rights Project.

TRLA is representing 19 adults from Cameron, Hidalgo and Starr counties while the TCRP is representing the 23 children, according to court documents.

"It is absolutely illegal. The federal government Constitution says anyone born within the U.S is entitled to privileges and immunities of U.S citizenship," TCRP senior attorney Efren Olivares said. "The most fundamental privilege of being a U.S citizen is a U.S. birth certificate."'' ------

''without a proper birth certificate the children can't receive Medicaid benefits, enroll in school or be baptized by the Catholic Church. Olivares confirms a lot of the children involved have disabilities and need special services.''

It’s a simple problem with a simple solution. These parents lack legal documents showing their identity, but have a record of birth from the hospital. All they have to do is go back to Mexico and get proof of identity and then apply...........

Exactly. A drive-by ID from a Mexican consular satellite office specifically set up here to hand out undocumented/unsubstantiated IDs isn’t valid proof to Texas - as it should be.

Thank you for getting closer to the point (instead of shooting at the messenger), both of you.

Darksheare, they are absolutely illegal. And they aren’t making any bones about their intention/ purpose of cashing in.

This attorney either no comprende ingles or he’s actually thinking they can insist the law says something it doesn’t & they can get what they are demanding *because* they ‘’don’t understand’’. Don’t be surprised by this. It’s worked before or they wouldn’t be doing it now. I doubt this would have worked with Border Patrol (once upon a time, at least), but it *often* works with government offices & apparently, banks. I know it works buying cars. (Ever try to buy a car without a valid DL & proof of insurance? You can’t. But they can & they do.)
This is a good example of how we got where we are. It all depends on who is behind the desk.

It is a scam & a mess.

Jurisdiction is when a court can make a decision with regard to a particular case or circumstance. There’s nothing about it inferring rights or obligations by the court or whatever that ‘’has jurisdiction’’. Jurisdiction doesn’t imply that the person is entitled to a birth certificate or other documentation- especially if they don’t meet the legal requirements for obtaining that documentation.

Unless I’m misunderstanding this, a court can make a decision whether a person has proper ID, committed a crime, or is in the country legally or illegally, based on the laws in that ‘’jurisdiction’’- what that court has authority to adjudicate/ decide. A person is subject to the laws of where they are no matter where they came from.

I think the confusion might come in because of 0bama trying to say that the court has no authority/ jurisdiction. According to him, the illegal is free to do whatever he wants & no one can tell him otherwise.

In Texas, 15 or 20 of them just move into a house. (There’s that we have to have ID to rent something, but they don’t again. They do it with apartments, too. There are just fewer of them.)

So do the Chinese. Last year, 20 something Chinese were rousted out of a house a couple of blocks away. A nearby restaurant set them up in the house. They worked there. This is a nice neighborhood, with doctors & professional people living here.

If Mexico claims jurisdiction, then I read this to mean that recognizing Mexico's claims means these folks aren't citizens.

Well, thanks, Rita. You’re right. It is a big deal. This is a huge order because this is the culture in South Texas & it’s been this way since long before I was born. My grandparents debated moving back from West Texas because of it in 1962. They lived here from 1919 until WW2, then moved to Laredo so my grandfather could work in the defense plant.

This is why we need the federal government to do their part protecting the border. I don’t know how to motivate them to do that, short of starting a war. (not advocating that!) I’m not optimistic about dealing with city & county officials- but it’s worth a try, I guess.
Every year, it gets worse & we were overrun a long time ago.

I would be happy to do that, but this is only my third or fourth post. I’m not good at it, I don’t think. If you or someone, could advise me what the ins & outs are, I am game for it. I don’t know how many news websites that would be. Let me try to add them up. If we have FRiends in the Valley, SW Texas, deep South Texas (Carrizo Springs/ Crystal City/ Eagleford Shale area), the Coastal Bend up through Austin. San Antonio, of course. Houston & DFW are affected. I don’t know how far this is spread northwards. El Paso & Pecos has issues, no doubt... Dividing up the state- or at least the area, would help.

The make up of government (city/ county) matters, too.

I don’t see how Mexico can claim jurisdiction within the US border, any more than we can claim jurisdiction in any part of the territory belonging to Mexico. Now, either country could *ask* to extradite one of our, or their citizens, respectively & the country asked may comply, but they don’t have to. Neither country can act on the other’s behalf- only on their own.

Could someone kindly clear this up if I am incorrect in my understanding?

If I’m on Mexican soil, it doesn’t matter that I’m am American citizen. The Mexican government can lock me up & throw away the key, haul me off to the Darien Gap in Columbia & drop off. I am technically at their mercy. The same is true of Mexican nationals on American soil. Unless there is some sort of agreement between the 2 governments (This is a formal agreement not smiles & handshakes), this is how it is. And even with an agreement, there is no guarantee. ‘’Accidents happen’’. Like el Chapo, Fast & Furious, etc.

I think you are well informed, enough to contact Breitbart Texas, and maybe report for them from your own neighborhood.

Just following news and related events is their game and send them your stuff. A little documentation to back it up so it can be confirmed is the best requirement to keep.

Thank you for your advice, Rita. It’s much appreciated. Those are good thoughts. I think I’ve figured out how to make a list of people to ping now. Maybe not the way others do it, but will work on this computer.

Just stick 3 or 4 names, like mine, in your “TO:” box on stories related to immigration or anchor babies, and you could even post your own report up, in what’s called a “Vanity” thread. You just type “Vanity” after the headline you choose to give it, then find and fill out the “POST” page, to publish it on the main “Forum”.

I didn’t realize you are new to the site, but you will pick it up fast. Look over the page called “POST”, on your cross bar, at the top of the thread page here, and see what you think.
