Any clerk that put Mrs Davis name on a marriage license is committing fraud and is criminally viable. I hope someone is informing the assistant clerks of that little fact. The assistant clerk in tears today at court should call in sick.

There is a concept called “delegation of authority” in every corporation.
If you are not in the chain of the delegation of authority and for the proper reasons, you are committing fraud.

According to the state law I read, if the county clerk is not available, the county judge has the responsibility to issue marriage licenses. The statute says nothing about the deputy clerks having authority to issue licenses.

I get the distinct impression that Judge Bunning, being a Federal Judge, isn’t all that familiar with the intracacies of state and local law pertaining to how a county clerk’s office is run.
He seems to be winging it. Especially in saying that there’s a risk that the licenses are invalid and it’s up to the couples to accept that risk or not.
Then after they're married and da judge gets thrown in the slammer for forgery, the happy couples will find they've been living in sin.

It might not be a forgery, but it can be fraud since it wasn’t authorized by her.

It is both forgery and fraud, worse yet, it is CONSPIRACY to commit forgery and fraud, if you check the Federal laws, you will find that conspiracy is about the worst.
Yet she languishes in jail... only because her religion, which was valid when she took office, does not allow for gay marriage. And 200 years of history tell us she is correct.
500 years of history tell us the same.
1000-2000-5000 years of history tell us likewise.
Now I am not against “civil unions” for gay people, for what it’s worth.
But this goes well beyond “civil union”. It ELIMINATES the definition of marriage that exists in EVERY dictionary since time began!
Americans will never stand for it.
