…………….the lady clerk (ELECTED OFFICE) in Kentucky sits in jail, and was offered freedom if she allowed assistant clerks to sign QUEER MARRIAGE LICENSES……….she refused once again. When she took office there was no legal QUEER MARRIAGES, The rules were changed by the SCOTUS, but they DO NOT WRITE LAW, they enforce, and clarify existing law. The federal QUEER MARRIAGE LAW is NOT A LEGALLY written law, by Congress, therefore it is Constitutionally not enforceable. She will now be eligible to file a huge lawsuit against the Judge who found her in contempt of court. She was duly PUBLICALLY ELECTED to her post, so now we have precedence against the SLIMEY San Francisco Mayor and his cohorts. He refuses to enforce Federal law also. Now he too should be given some slammer time to think about it. This is exactly the same thing except with a religious aspect added, I reiterate an ILLEGAL LAW was used as a charge against her which resulted in her being jailed by a Federal judge who is paid by Soetoro. THE SCOTUS DOES NOT WRITE LAW, WHICH IS EXACTLY WHAT THEY DONE. THE LAW IS FATALLY FLAWED, BECAUSE THEY REFERRED TO TWO PEOPLE OF THE SAME GENDER,AS MAN AND WIFE. THE WORD WIFE IN WEBSTER’S COLLEGIATE DICTIONARY IS DEFINED AS “A WOMAN”, NOT A MAN. This illegal law was PUT UPON Ms,Davis AFTER she was elected to her county clerks position. While she agreed to uphold the laws of the state of Kentucky, she DID NOT AGREE TO UPHOLD PERVERTED FEDERAL LAWS. Sadly the appellate court upheld HER contempt citation. This tells me that the judges are still the alleged GOOD OLE BOYS CLUB of YESTERYEAR. …….and much like DOGS HIND LEGS, which makes them KANGAROO COURTS. Hopefully I will live to watch this all get shoved right back down the Soetoro cohorts throat. I joyfully congratulate her for standing her ground against the SICK, TWISTED MALE BASTARDS who were trying to get married. btw ONE OF THEM REFERRED TO HIS QUEER LOVER AS HIS SOON TO BE WIFE. I BELIEVE THAT SUCH A REMARK TELLS THE STORY AS TO HIS SUBHUMAN MENTALITY.
My guess is this is the type of judicial system actions we will see under the now United States of LGBT, they only adhere to a constitution with one article: BOHICA.

He was in Rowan County doing his job, and she was 60+ miles away in Boyd County at the Federal Courthouse.
What’s worse, our a$$hole Attorney General Jack Conway, and our a$$hole Governor Steve Beshear, both Democrats, as is Ms. Davis, have done nothing to support her or uphold KY law.

When I answered your question, I goofed because I assumed you were the one who made the comment about the judges. Right after that I realized the mistake.
Anyway, the real answer to your question SHOULD have been... I wasn’t arguing with you.
Jugdges can not make “the law of the land”. They can hold laws to be unconsttutional but they can not order states to pass laws. Kentucky ca choose to not isue tate sanctioned marriage licenses or they cn chose toissue licenses to hetros and homos. They have done neither and until they do there is nothing to compel.
So if I understand the SCOTUS ruling, the laws that make marriage only between a man and a woman are unconstitutional. Ok, we don’t agree with the ruling but nothing in their ruling changes the Kentucky law as it stands on the books.
This clerk has decided to not issue any license (including heterosexual marriages). That seems like a reasonable approach considering there is no valid marriage law on the books in Kentucky.
The court did not rewrite each state’s marriage law but they have invalidated ones that specify traditional marriage.
Unfortunately judges act like kings.

You realize the basis of our common law judicial system is judge made law, right? Most of the law we have today is codified common law doctrine. Negligence and contract law are two huge areas developed in successive upper court decisions. Divorce law in most states has a common law basis. Not here in California; we have community property. The Constitution is ripe for interpretation and creating laws. You are afforded “due process.” What the hell is “due process”? Can’t you see? It’s the process that is due. The Supreme Court fashioned a law that said “due process” is notice of the action against you and an opportunity to be heard before a neutral, detached magistrate. Otherwise, the government could say “due process” is a secret tribunal where we determine your real punishment after a speedy show trial before a jury of your peers.
You think you are smart but you are not. There is no Kentucky law or Federal law that compels Kentucky county clerks to issue marriage licenses. And she has chosen not to issue any. So its not even as though she is issuing them to normal couples but not to gay couples.
It is customary for Kentucky county clerks to issue marriage lessons but there no law demanding they do so. I hope the gay maggots and ACLU get counter sued for millions and lose.

If I were her I would post a big sign in her office saying, “Sorry but we are not issuing marriage licenses in 2015 and 2016” “We suggest you try the neighboring counties”

That’s what I’ve heard. If it’s true, she is acting on her personal beliefs while forcing her assistant clerks to also act within her beliefs. Apparently no one sees a problem with that.

There have been people jailed ten years plus on civil contempt.
