Will take action against firms that replace American workers: Trump
Rediff Business ^ | October 31, 2015

Republican US presidential hopeful Donald Trump has asked Entertainment giant Walt Disney to hire back every employee they replaced with low-wage H-1B workers, including Indians, and vowed to take action against firms that replace American workers if elected to the top job.

Disney in June had laid off about 250 employees and replaced them with Indians holding H1-B visas. "I am calling today on Disney to hire back every one of the workers they replaced...," Trump said.

If elected, Trump said he would take action against companies that replace American workers.

This sounds good until you think about it. Exactly what would he do, would he authorized to do this and under what law. I wish he would cite the authority.

It's utterly black and white. You don't dump your own citizens who are competent and educated on the unemployment line so that you can import two guys from India to take their place. This is the only country in the world stupid enough to do that.

That's not the entire picture. I listened to Ted's explanation. There is another side to this.

Extremely tortured logic that an employer that takes advantage of a government meddling H1-B visa program to begin with has any “right” to be free of government interference.

These visas should NOT exist to begin with, except for some very limited exceptions where no American jobs are being replaced for mere convenience and the person/persons are truly doing a job that an American would not otherwise be doing.

It’s absolutely crazy in this country that we put foreigners ahead of our own when it comes to jobs. What sane country does that?

It’s not a simple, black and white issue.

I appreciate the rational thought. But something in my mind says that was then and this is now. Something has changed in the implementation of a well intentioned law.

I don’t think I even heard of that event. It must have been a long time back. Plenty of them here in the midlands.

It was at one of those chicken processing plants near the Upstate. The HR gal in charge of hiring was actually helping border jumpers get fake paperwork so that she could keep a steady supply of minimum wage chicken pluckers coming in door.

I called my congress critter in Oconee County about the issue several years ago and asked if he was going to lead the charge in cracking down on all the construction companies in Oconee County hiring border jumpers. He geed and hawed and shucked and jived and I knew that he had no intention to do a damn thing. I just let him talk babble for a couple of minutes and said thanks for nothing and hung up.

There have been numerous legal and Constitutional actions outlined in responses to you that President Trump CAN take on this issue but the greatest is 'the bully pulpit' of the office.

With the dissatisfaction levels of voters and a general desire to kick out foreign interlopers, he can do to the re-election chances of any RINO/uni-party traitors, who they insist on replacing US workers, what an Anteater does to a termite hill. After all, this has proven an issue that seems quite near and dear to a great MANY Americans.

Personally I`d trash them in the media and at EVERY opportunity I could till they CRASHED AND BURNED! Now do you think that would be effective and Constitutional?

Could be. I don't know enough about it. Ted made some good arguments. I respect him, so I'm open minded about the subject.

And yes, the Disney thing should make anyone's blood boil.

Even the incompetent ones?

People need to understand the outsourcing history at Disney. Their IT organization was largely incompetent, which resulted in it getting outsourced. No CTO worth their salt us going to replace a department that is performing well.

He could ask for legislation to get rid of the H1B program.

Actuality he would just need to strictly enforce the provisions under the H1B program to the letter. 90% of them would just go away as companies would have to pay the aliens the same as US citizens.

Right now no one is enforcing any immigration laws.

Here’s the way this went down, to the best of my knowledge. Disney’s IT sucks and has for years. Anybody who deals with it on a routine basis knows this. I’ve cited examples in other threads.

So. Disney starts to use a local contractor for some jobs, with impressive results. Disney decides to move more of its IT jobs to the contractor.

Orlando is a unique marketplace. Disney and Universal have huge footprints that the local labor market does not support. This is why both theme parks have extensive college intern programs; they need to recruit far and wide to overcome the labor limitations of the Orlando job market. That works well when hiring college kids looking for excitement and a resume bump.

It doesn’t work so well for professionals settled into their lives and families. So, this contractor expanded its search.

HB1s aside, Disney needed a change in its IT direction and they found a contractor that provided them proven results.

The issue isn’t so black and white.

Nevertheless, Trump didn’t address any of that.

Instead, he said he’d force Disney to rehire people they no longer want working for them. And that’s alright with y’all? It’s OK with people here for the government to force employers to sign paychecks for employees that they do not want? Wow.

Would it be OK for President Obama to decide today that every company with ten or more employees must hire two more at the same salary, because the sky is blue, or to stimulate the economy, or just because it’s Saturday and too wet to golf and he’s bored?

Be very careful what you’re supporting here: if the federal government should be allowed to force the private sector to hire hundreds of employees at its discretion instead of the employer’s then that applies to anybody in that office, including its current occupant.

I don’t care how allegedly “incompetent” the IT staff was at Disney.

I guarantee you when they are replaced by cheaper Indian labor, those fired Americans on the unemployment line, will look like MENSA scholars compared to the really incompetent Indians they hired to take their place.

But many of the Americans will be struggling, looking for a job, depleting their savings and getting government assistance. Who do you think will pay for that? The Indian government or you and I at the end of the day?

America should look out for Americans first. Period.

That’s fine, but what ‘action’ could be take?

The last seven years aside, the president does not make law”

I thought the same thing. Telling a company whom they can hire is as intrusive as anything Obama has done. Just make it more difficult for people to come here and work.

This well-abused H1-B visa program is government interference in the job market to begin with. So I reject your premise. Disney had to apply for these slots under the law.

The program is not intended to put Americans out of work in favor of cheaper Indian labor, but it has been abused by crony capitalist Fortune 500 companies to be just that (at the expense of smaller companies with less juice that want to outsource like this as well).

I am pretty sure if the true goal was to “fix” Disney’s “broken” IT department, you could get the job done with Americans, if you paid enough and paid relocation expenses or allowed some to telecommute.

But Disney doesn’t want to pay for that. They’d rather get involved with what is likely a shady Indian outsourcing company.

Don’t worry you ultimately get what you pay for. If you think Disney’s IT department has issues now, just wait until after these American jobs are outsourced to foreign workers.

Exactly. That us one of the things that bothers me about Trump. All I hear from him is I, I, I. He’s like the current POTUS in that regard. When Trump speaks I envision more and more executive orders and forced legislation by the federal government. I may have no cause for alarm, but I don’t know.

Disney is shameful, not to mention tone deaf and idiotic here - as well as immoral.

However, I do not want a President taking unilateral action against companies who operate in a manner he doesn’t like - even if I don’t like how they operate either. Hell, there’s virtually nothing Disney does I do like. I certainly don’t like how they run ESPN either.

But the Prez at war with a company? Um, where the hell does that stop? If he wants to outlaw the practice, that’s valid.

What you gonna do when he takes unilateral action you don’t like?

Remember the good ole days, when we were against a President - or any elected official for that matter - declaring war on a particular American company or industry? You know, property rights, limited government, the Constitution, what the hell ever that is.....

Wasn’t this the heart of the Chick Fil-A thing? You know, mayors punishing a company they didn’t like? Heck, even a lot of non religious libertarian types joined us on this. I remember when FR was on the right side of this debate.
