No, because amending the Constitution requires the approval of 2/3 of the states, and that process was part of the original Constitution those states agreed to.

If Hillary simply declares the Second Amendment “null and void” that is a different matter entirely, and would result in court action before secession.

Nope. By your own statement, the Constitution at the time included the power to amend the Constitution. So, as long as the replacement Amendment were passed according to the proscription for the amendment process, the answer is no.

They are Machiavellian power seekers, and will do whatever they think will maintain their power.

I see multiple states north and south excluding NE and LEFT Coast rejecting any attempt at deleting the 2nd. I personally will move to the first state that secedes from an unconstitutional America.

The law on secession is simple. If you win, it was legal. If you lose, it was treason. Fortunately, the liberals who want to control our lives are sissies. I don’t believe they would fight.

If the Free States (whatever states that turns out to be) secede, I think they will be permitted to leave peacefully. The left has repeated their mantra that the flyover states receive more than they pay in federal taxes so much that (1) they believe it, and (2) they think that is what matters in a federal relationship.

We have just cause to secede already.

They won’t need to repeal - they just have to stack the SCOTUS to give them the power to do whatever they want. Unconstitutional? Yes, so what, it hasn’t stopped Obama.

In an earlier post today they show a passel of U.N. armored vehicles moving down a Virginia freeway.
That would be fine a I would have a problem taking out Americans coming for my single shot .22 rifle.
As for blue helmets? no problem at all.
Get the U.N. out of America.

The populations that previously composed South and North no longer exist in the state they were in at the time of he Civil War. The demographics have changed so radically you would be unlikely to see a clean division between North and South. Maybe divides like “West Boca vs East Boca” or something like that. So many Northerners and South Americans have moved throughout the South you'd not likely encounter a large enough united coalition to get a vote on secession.

The social contract changed in the 1930s. It had been “protect us and otherwise leave us alone.” With the New Deal, the contract became “take care of us and we will surrender our rights.”

The current social contract is now similar to the feudal contract between serf and noble.

I think any state should have the right to leave at any time...just like Brexit. Have a referendum and leave if the voters don’t like the situation.

I think the south would have been allowed to leave, without bloodshed, if they hadn’t seized federal military installations throughout the south. An overlooked part of history is the south’s offer to pay for those installations, after they were seized (too little too late). Imagine if they had made the offer first...would there have been any support for war in the north?

The current system with massive federal power is not what any of the states agreed to...not even close.

Obama violated bankruptcy law and business contract law by saying unions get their share of car company assets ahead of secured debt holders, many of them retirees.
And courts let it stand.
In light of that, I don’t think contract law is a basis for challenging violations of the Constitution.

They don’t have to repeal the 2nd Amd. If Hillary wins and selects the next supreme court justice and probably another two or three along the way in the next four to probably eight years, there is no need for a repeal. They will rewrite all the laws using the supreme court. They will throw away all the gun laws to support doing away with the amendment without having to do a thing to the Bill of Rights. This election will destroy the nation once and for all if she gets in the White House. The supreme court controlled by the liberals will see to that. THAT is what this election is about. The next justice and those that will be selected in the next few years.

I do not believe there is any need to determine the legality of secession anymore. The federal government has ignored federal law and the Constitution for decades, and behaves as if no legal boundaries exist. Furthermore, federal law is selectively applied and used in a inconsistent and even criminal fashion. Elements of the government are used to punish political opponents and create fear among its critics. By ignoring, and misusing the Constitution and the law, the federal government has given the people the justification for secession. The federal government has, thus, self identified itself as a tyrannical enterprise. It is the natural, God given right of the people to rid themselves of tyranny, and God’s law is far superior to the laws of man. Secession seems a proper way to shake off the shackles of tyranny, and if there needs to be a fight then let there be a fight.
