Police: Suspected Drunk Driver Opens Beer In Front Of Officers

MADISON, Wis. (AP) — Madison police say a suspected drunken driver disobeyed an order to get out of her car and instead cracked open a beer in front of the officer who stopped her.

Police say an officer on foot spotted an SUV driving fast early Wednesday on State Street near downtown Madison, where regular traffic is not allowed. The officer jumped into her car and pulled the driver over.

Is there a law against opening a beer in front of an officer? If so, the legislators responsible for that absolutely need to go.

Know the mindset well. Have a friend from WI, comes down for deep sea fishing. Beer for breakfast. He looks at me and says “What? Everybody knows drinking beer isn’t really drinking.”

Most, if not all, states have laws on the books that prohibit having an open alcohol container in a car. Those have nothing to do with whether or not a cop is present when it’s opened.

Saw a guy in front of me driving erractically and swerving all over the road from urb to curb. Called 911, thinking he was past sleepy or drugged or having a seizure.

He finally pulled into a parking lot, opened the door, and literally rolled out of the seat and onto the pavement. Then got up and staggered towards the liquor store.

Then the cops showed up. Ends up that I was the only person who swear that he “was driving drunk” ... Nobody else could provide evidence he (1) was drunk, (2) was driving and (3) was doing both at the same time.

Seems like his lawyer was going to use a defense of “the cops couldn’t prove he was driving drunk” because they only “found him laying on the pavement drunk”. Not in the car while it was moving.

I know a judge that left the scene of an accident he caused, drove home and was found with an almost empty glass of wine when the officers arrived.

He knew the consequences for leaving the scene were less than a dui.

In the drivers drunken mindset, maybe she figured she was busted so why not chug one and then try and claim the only drink she had was ‘after’ being stopped so she was never actually drunk ‘while driving’.

Of course that makes little sense, but she was drunk after all. LOL.

We pulled up on a loaded concrete truck that turned over while making a turn. The driver is standing on the door and we can see him through the windshield chugging a beer. He was drunk enough to not injure himself but was rewarded with a DUI after we got him out.

Some hours later we had the road cleaned up.

A lady lawyer did that in a town near me.

She hit a farm tractor, left the scene, drove home, and was never charged with DUI even though she was smashed when officers got to her house just moments after she pulled in her garage.

That depends on how many she had. While it is considered "polite" to offer your last beer to an officer, it is not considered "rude" to keep it for yourself. On the other hand, if you have two or more, you should offer the officer one for sure.

In Virginia a ploy to avoid DUI. Opening and drinking a beer in front of officer brings into question the extent of intoxication before driving. You might get public intoxication instead of DUI, the more serious chsrge.
