Totally agree. But then, they’re just following the lead of the sports talking heads, who now see themselves as cultural and social philosophers and never miss an opportunity to tell us what we should think.

There is no undifferentiated constitutional right to “protest”.

There is a prohibition, which applies to CONGRESS, against passing laws which abridge the freedom of SPEECH. Congress is also prohibited from passing laws which prevent peaceful assemblies and which prevent petitions to the government for redress of grievances.

“Protests” are not protected by any of these limits on Congress. In fact, prior to the 1960s, “protests” were routinely broken up by police wielding truncheons and in at least one case by the US Army (commanded by Douglas MacArthur) on horseback.

Taking it one step further, the San Francisco 49ers are not Congress, and they can prohibit whatever they want.

First Amendment: An Overview

The First Amendment of the United States Constitution protects the right to freedom of religion and freedom of expression from government interference. See U.S. Const. amend. I. The Supreme Court interprets the extent of the protection afforded to these rights.
