Why judge acquitted St. Louis cop of first-degree murder

A citizen would not be confronting a dope dealer or chasing him. A citizen has no duty or responsibility to do so and pays taxes for police officers to do this in their stead. With the Castle Doctrine and Stand Your Ground laws it is far less likely of being convicted. However, you still must be legally and lawfully present and inject the self defense argument.

The court has to prove that the officer was not acting in defense of self or others AND outside the scope of his duties.

This was BS case issued by a retiring DA who was pressured into issuing on it five years later by local SJWs.

It should have never been issued and I hope Stockley sues the City of St. Louis District Attorney’s office for malicious prosecution.

What we are seeing and have seen with Ferguson is political correctness run amok. No one seems to care that Stockley was a West Point Grad and was wounded in the WOT.

I think the decision was probably right.

Probably? There is no way that a homicide under these circumstances could constitute 1st degree [i.e. premeditated] murder.

Stated facts in this case:Stockley ordered Smith to open the door and show his hands. It was not until 15 seconds after Stockley arrived the driver’s side door that he took his service revolver out of its holster and fired several shots.

Sounds like the cop was smart to opt for a “bench trial".

Every cop on trial asks for a change of venue. If that is denied, he waives his right to a jury (resulting in a bench trial). As long as he gets either, he's usually in good shape.

If someone tries to crash their car into you, then pulls a gun on you, and you shoot them, you're pretty likely to be acquitted. Civilian or officer. Actually, you're probably not going to face any charges unless you are a police officer in a racially charged city.

Self-defense is a recognized defense for every person in every state.

If you watch the video it clearly appears justified.

Also the prosecution never charged that he planted the gun.

Pure speculation on the part of the dindu nuffins.

Sure doesn't look like he had the opportunity.

The question isn’t about the shooting, the question is about the prosecution. Having the state have to prove it wasn’t self-defense (in this case of a cop) vs. having the citizen try to prove that it was (in most self-defense shootings done by mere citizens).

No police department in 2011 was still issuing revolvers. Again, idiot reporters have no clue when it comes to firearms.

St. Louis voted to allow these violent acts of domestic terrorism when they elected the Demonicrat kakistocracy to run the city. Whatever happens to St. Louis, like with Detroit, Chicago, Baltimore, etc., they brought it on themselves.

Voters in other cities should note well: Your city will be destroyed when you vote to put Demonicrats in charge.

Prosecutors, acting on the emotional needs of a largely uninformed and perpetually aggrieved segment of society, will tend to over-charge crap they can't prove. Exhibit A, Marilyn Mosby, Esq., Baltimore State's Attorney, charged 6 cops in the Freddy Gray case with crimes, which in order to find guilt, must have an element of "intent". 3 acquittals, 3 dropped charges, IIRC. Mosby 0 for 6.

In this case, 1st Degree (pre-meditated) murder was definitely an over charge. But when dealing with the BLM crowd, keep your facts at home, they won't matter.

If he had shot the scumbag as he fled, it would have been self-defense in any sane criminal justice system. Hi-speed chases are a danger to innocent people.

Of course, police officers are commissioned to protect the public and have the right to take down criminals that vigilantes don't.
