Although I'm surprised, I can't criticize. Two courts of appeal have reviewed the record (which none of us have) and came to the conclusion. I though it would go the other way and I was very wrong. So be it.

So, now what? Do they immediately return those particular children? (Am I right in recalling there was a 10 day period in which to do it?) Also, do they just accept the word of the parent(s) as to which child goes where? Do they wait for DNA?

CPS failed to allow due process and now anything that they thought they had as in violation of law will be dust in the wind. The state even tried throwing out a picture of Warren Jeffs kissing an underage girl but the TSC saw right through that stunt. Warren Jeffs is in jail.

Maybe the Supreme Court thought that the police should have more than an anonymous phone call (that could not be verified) before they dismantled an entire community, seized personal property and took children away from their parents.

I tend to agree with this decision. What CPA did was unlawful. I’m all for protecting the children, but it has to be done in a lawful manner. In this case, it was not.

Pretty lame. There is ample evidence that young girls were 'married off' to older men in this case. At least 15 girls under 18 are or have been pregnant.

Posted: 3:05 PM- SAN ANGELO, Texas - The Texas Supreme Court today turned down the state’s request to overturn an lower court’s ruling that that hundreds of FLDS children have been taken into state custody improperly.
The high court’s ruling comes a week after the Third Court of Appeals ruled that some, if not all, of the more than 450 children in state custody should be returned home to the Fundamentalist Church of Jesus Christ of Latter Day Saints’ ranch in West Texas.
The children were taken into state custody during an early April raid on the YFZ Ranch, based on the state’s contention that all were at risk of sexual and physical abuse due to the sect’s practice of polygamy.
The children are in foster care or shelters scattered about the state. Those 12 months and younger can have their nursing mothers with them, and some have been reunited with their families but remain in the state’s care.
The raid was authorized by 51st District Judge Barbara Walther in San Angelo, who also ruled after two days of hearings that the children should remain in custody. The appeals court found last week that Walther lacked sufficient evidence to support the state’s claims that all of the FLDS children were at risk.

Courts never give a d*** about kids.

Besides, this will make it easier for Texas courts when Texas’ substantial Muslim population starts openly practicing polygamy and openly giving away 12 year old girls to daddy’s 50 year old friend. That way if some brave girl complains, it’s all already decided. They’ll just send her back to daddy, daddy’s friend, and maybe an honor killing if she continues to rebel.

Now perhaps TX CPS can remember to follow the law in continuing their investigations. If they have evidence that any kids have been physically or sexually abused or were in imminent danger of such abuse, then they should do all in their power to protect those kids.
BUT - as for all the other kids - Leave them alone!!

cherry - No one is defending raping anyone. It’s “just” that CPS has to follow the law, which is: To remove a child, that child has to have been physically or sexually abused or be in imminent danger of such abuse, and that CPS made reasonable efforts to prevent removal.
CPS met none of these criteria, therefore TX Supreme Court and 3rd Appellate are correct.
Let CPS continue their investigations and follow the law this time.

Warren Jeffs is a creep but he's a creep already in jail so for anyone to use the photo to try and prove a point is really irrelevant in this case. If Warren Jeffs was the issue here then every child of Catholic parents should be removed because of what priest have done.

But let the kids stay with their siblings and mother and in the families where the fathers have only one wife......

No proof has been put forward that ALL the kids came from polyamorous families.....the cops didn’t even know the kids’ names for the most part...they just took everyone in the compound.......no proof any laws were broken....

And if laws were broken by some of the fathers, then try them and send them to jail..........but, keep the kids together with the mothers.....

Warren Jeffs was worshipped as a prophet (as Mohhamed-sp- is to Islam?!?!) to the people AT THIS COMPOUND. Not just as a religious thing, but as a personal “Warren Jeffs is our leader” way. His picture was on their wall!

Yeah, save them by taking them away from their parents at gunpoint, putting them with strangers, giving them a physical exam that includes anal and genital probes, and make them live with strangers who might as well live on Mars in terms of lifestyle.

Then have politicians try to seize their entire world to pay for this whole thing, while their parents bankrupt themselves with legal bills.

Do all of this of this on non-existent evidence, rumor, conjecture, and expert opinion.

That will DEFINITELY save them!
