This shouldn’t be considered an accident since the sex was consensual, there isn’t any way the auto was involved in an accident.

I believe that was California, Bigbee v. Pacific Telephone, 1983.

The CA Supreme Court ruled 6-1 in plaintiff’s favor that the phone company was negligent in placing a pay 15 feet from a busy road.
