While trying to research the truth (something many on this board refuse to do), I came across this website/blog run by a Florida Legal guy. I think this is the most comprehensive and straightforward presentation about this tragedy. He does not any judgements, he presents the facts. I think everyone should read this. It was hard to copy and format, so please go to the URL and read it the way it was originally formatted. I found it absolutely fascinating.

My name is Michael Shiavo and I hereby order ALL of you dimwit Freepers to cease and desist from making your false accusations against me, d'ya hear me?

I love my wife , Terri, with all my heart and soul. I have never, ever, done anything to harm Terri. In fact, I have bent over backwards to see to it that she receives all the help and therapy that she needs and deserves.

Furthermore, because Terri told me she would never want to live in the condition that she is in (fed via inserted tube), I am lovingly doing everything possible to fulfill her declared wishes.

And finally... if you don't get your ignorant Freeper a@@es off my case, I will see to it that your logon tubes are removed... so you can gently dwindle down into Freeper eternity !!! ;-))

Starving someone to death is murder. Perhaps I should use a euphemism so as not to upset people.

Michael Schiavo did not make the decision to discontinue life-prolonging measures for Terri.

As Terri's husband, Michael has been her guardian and her surrogate decision-maker. By 1998, though -- eight years after the trauma that produced Terri's situation -- Michael and Terri's parents disagreed over the proper course for her.

Rather than make the decision himself, Michael followed a procedure permitted by Florida courts by which a surrogate such as Michael can petition a court, asking the court to act as the ward's surrogate and determine what the ward would decide to do. Michael did this, and based on statements Terri made to him and others, he took the position that Terri would not wish to continue life-prolonging measures. The Schindlers took the position that Terri would continue life-prolonging measures. Under this procedure, the trial court becomes the surrogate decision-maker, and that is what happened in this case.

I'll bet he wishes he'd not bothered to take the parents doubts into court. Otherwise he could have arbitrarily refused treatment and ordered the tubes removed and a DNR on his authority as guardian.

So much for the attempted murder theory.

So what bothers you more, the actually death or death by starvation. You know as well as I that the only way Florida allows is by disconnecting the feeding tube. So it's a non-issue. I agree, I think once the decision is made there should be lethal injections given, but because of people like you it remains the feeding tube. So again, take a bow.

When did I say I was impartial? I thought this article was a good impartial insight into the case. Look, I know how you feel about this. You have the right, as I have the right. But the fact is that what is happening is legal in Florida. And everyone is acting in accordance to the law in this case. If you don't like the law, go do something about it.

I agree, ladyjane ... starving someone is murder. Nothing less. Starving someone on the pretext that she wanted relief from tubes is attempting murder. Gastric tubes at the time of Terri's collapse were nutritional, nothing more. VENTILATORS were life-sustaining measures. You've got to give the Merchants of Death credit ... they know how to change the language. You've got to give Terri credit, too ... she could see far into the future when VENTILATORS would become TUBES, such was her desire to die. Amazing. Only one thing is wrong ... she's not dying. In order to die, she has to be killed.

Very interesting - a clear summary of what has happened and what the legal issues are WITHOUT the emotionally charged rhetoric that normally accompanies any reference to this case. As other replies to this article show, many people have made up their minds (one way or the other) and are now completely impervious to new information.

Thank you for posting this. It really does clear up a lot of misperceptions and sheds light on some of the more hysterical claims being thrown around.

All the court documents are referenced at his site.

You can't read them and not see the distortions and outright lies perpetrated by well meaning zealots in this case. I live here in Pinellas County and we've followed this story for 15 years. If there were any hint of malfeasance on the part of any of our elected officials there would have been a tremendous uproar from a big chunk of the 3 million people who live here. Drive by Woodside and and see 30-50 people protesting. And most of them are snowbirds. And Judge Greer(R) just won reelection with nearly 70% of the vote.
