I don't see what Churchill and Co. are trying to prove, this case isn't First Amendment, it's academic fraud, copyright infringement (the artwork), misrepresentation(his lack of a degree).
The First Amendment guarantees his right to spew whatever B.S. he wants to, it doesn't insure that CU has to give him a pulpit from which to spew it. His "lawyers" are clutching at straws by going after First Amendment.
Anyone who's had his class should sue him and CU for selling a defective product. Communism. It's defective. Communism hasn't stood up to the test of time as a successful socio-economic policy.

At every industry job I've ever held, a mis-representation, or outright lie, discovered after my hire date would have been cause for *immediate* termination.
Period. No buy out. No fringe benefits. Nada.
I can't understand why gov't or academic types seem to get a pass courtesy of the double standard.
I agree with your later point that a PUBLIC accounting of his fraud would be a good step. But, I think that that, too, will be swept under the rug.
And I hate to see him walk away with all the tax-paid bucks to boot.
