Kyl Explains Why He Doubts the Democrats Will Use the "Nuclear Option" to Pass ObamaCare - Video

Here is video of Sen. Jon Kyl on with Greta Van Susteren tonight where he talked about the possibility that the Democrats will opt to use the "Nuclear Option" in the Senate to ram through a Government Health Care Bill. Such an option would mean they use what is called the "reconciliation process" which would only require getting 50 votes (+ VP Joe Biden to make 51 votes) to bring a bill to the floor for a final vote, which would again only require 51 votes for final approval. Under Senate rules, a bill usually requires 60 votes to invoke Cloture, which allows a bill to come to floor for final passage.

Kyl said the Democrats may do that out of frustration, but he doubts it. Kyl said there are two reasons he doubts they will do it:

1. The "Reconciliation Process" is not designed to pass this kind of legislation. There are many provisions it would be difficult to include under this process.

2. If they use it, they will clearly be doing it to thwart the will of the American people. It would make them look desperate and out of step with public opinion. . . . . (Watch Video)

Great move for Sen. Kyl to analyze it in this way.

If they do go ahead and use it, the pre-analysis can be used as an attack of why it was wrong. Totally puts them on the defensive.

Let’s hope he’s right. This is too big of an issue to be messing with for purely political reasons. Literally, our lives and the lives of America’s children are at stake.

Reconciliation could conceivably be used if the Democrats want to twist the intent of the law. The law was passed in 1974 as a means of lowering the deficit. The Byrd Rule provides tests to that end, and a rational person would say spending on health care goes the opposite way. Obama has been arguing that his proposal will save money, and they could use that excuse. The Senate Parliamentarian could rule against parts of the bill, and I think he is a Republican, if memory serves. In other words, the Democrats could possibly wiggle and worm this debacle through if they can get 50 votes plus Biden.

The Republicans used reconciliation at various times for tax cuts, which was fought by the Democrats as adding to the deficit. The party in power gets a lot of say in deciding what adds to the deficit. The Republicans also tried using the law to drill in ANWR, but that failed for other reasons.

I frankly think they could use reconciliation for health care (as Clinton tried), but they'd be like the suicide bombers: Accomplish the goal but die in the process. I don't think they'd try it, but keep up the pressure on your representatives! I always act civil since I figure if my Democrat senator thinks I won't vote for him anyway, he has nothing to lose.

Speaking of Byrd, have they named a tombstone after him yet? Most everything else in West By God Virginia is named after him. I haven’t heard much from his handlers for a while and was just wondering.

Rush said it would be unconstitutional for them to use the reconciliation process for anything except the budget (I know I know, they trash the constitution every day).

Rush also said that if the Demons should do it, the Pubs could tie up the Congress for a year by requiring them to repeatedly read every bill in full on the floor of the House and Senate.

But Rush said same thing as Kyl, the feeling on the street is that the prolly won’t do it, tho they will be tempted.
