Could the President of the United States be arrested for illegally signing a fraudulent bill?

Here’s the sort of BizarroWorld question normally reserved for the latter half of a season of 24, where Jack Bauer’s up against a corrupt, out of control President who’s committed murder, plotted against the Constitution, or has attempted to otherwise destroy the United States he or she swore to protect and defend.



We wonder if the President of the United States can ever legally be arrested for a crime.

We believe the current administration has already committed several instances of an arrestable offense: the attempted bribing, for political reasons, of various individuals using federal jobs as said bribes. This happened on at least two occasions: Joe Sestak, who the White House tried to bribe with the Secretary of the Navy position to stay out of Arlen Specter’s Senate race, and Andrew Romanoff, who the White House tried to bribe with a job in the Interior Department so he would stay out of the Colorado Senate race.

Someone in the White House, possibly Rahm Emanuel and/or David Axelrod, should do jail time for that.

But, we don’t think the chain of culpability on the bribes will ever lead right up to Dr. Utopia, the illustrious current president, himself.

We do, however, wonder if Dr. Utopia can be arrested for signing a document he knows to be fraudulent and unconstitutional, thus committing a crime against the Constitution and breaking the oath he took on January 20th, 2009 at twelve noon.

The Constitution clearly states a bill must be passed, identically, in the House and the Senate before it can be sent to the White House to be signed. The President of the United States, thus, cannot sign any bill that has not been passed by BOTH the House and the Senate. Should a bill come before him that he knows has not been passed by both Houses, the President of the United States cannot sign that bill into law.

But, what happens if he does?

What happens if Nancy Pelosi and Harry Reid just skip voting on the Healthcare Rationing bill in the House, and send the bill the Senate passed on Christmas Eve, in the dead of night, largely in secret, directly to the White House and Dr. Utopia signs it?

How many people will have committed high crimes and treason in this instance?

Deliberately, all involved would have knowingly usurped the Constitution of the United States by disregarding the bicameral nature of our government.

The reason James Madison designed this document the way he did, and created the separation of powers the way he did, was PRECISELY to address instances where radicals take control of two or more branches of government and attempt to destroy the country. The House is up for re-election every two years for a reason. In 2008, too many radical Leftists gained power. The people are seeing the result of this now. In 2010, the people have a chance to restore normalcy and boot as many Leftists out as possible. The Constitutional requirement that legislation be passed, identically, in both chambers mandates sense and reason even in the worst circumstances for the republic, when Leftists have more power than they have ever had before (Hope! Change! Alinsky Methods!).

Leftists have the White House and control Congress…but not for long.

Enough pressure has been put on House members by a public outraged by what the Senate did at Christmas that the Senate bill will never pass in the House — hence, Pelosi’s scheme to just not have a vote, and to send the Senate bill to the White House illegally for the president’s signature.

What happens to Obama, Pelosi, and Reid if they really and truly do this?

Can the military walk into the room moments after Obama signs this bill and arrest him? Is the Secret Service empowered to arrest the President, or would that need to be done by the DC police, Federal Marshalls, or some other police force?

Can all 300 million Americans issue a citizen’s arrest for this man?

What crimes could Obama be charged with for signing a bill he knows is unconstitutional, which was not passed in the House, despite his requirement as president to sign ONLY legislation that was correctly and legally prepared, passed, and put before him?

Can Alcatraz be reopened to hold all Democrats involved in this conspiracy to usurp the Constitution and commit nation-destroying treason? If so, can they be caged in spaces open enough for tour groups to poke at them with sharp sticks — potentially raising millions a year for the island’s upkeep if the National Park Service charges something like $3 a piece for sharpened poking sticks?

I am not encouraged. Look how the Constitution was ignored regarding Obama’s natural born status. Do we even know if he is a citizen?

No. There just isn’t much a president could do that would get him arrested and its probably a good thing in a sense. That’s the sort of thing that happens in 3rd world hellholes and not the sort of thing we should aspire to.

Its kind of like the birth certificate issue. I don’t believe he’s legally there but I know that he won’t be removed over it. There are other means of correcting the system that can actually be implimented but even his most ardent opposition won’t try to remove him.

I don’t think there is any proof he even is a legal citizen. It seems to me that this question has arisen enough that its time someone..like maybe the Republican party should do a thorough investigation. I know that will never happen, but the actions of Obama and his thugs has risen to the point that all bets should be off.
If in fact he is not a legal citizen (which I strongly suspect) it is urgent that it be revealed. I shudder to think of the legal ramifications.

I am also very disappointed that nobody seems to be following up on the social security number issue as it would in my opinion could be bigger than the “birther” issue since it could reveal felony fraud of the social security system.

This question should have been answered during the Clinton administration, but wasn't. The presumptive answer, based on Clinton's activities, is no.

He could not be arrested, but he could and should be impeached. If Obama were to sign such a “bill”, I would advise Republican congressional candidates to openly run on a platform of impeachment. Given Obama’s approval ratings, such a platform would probably be a ‘plus’ even with many voters who voted for Obama.
