Rights groups denounce proposed bills to remove 'birthright citizenship'

Mexico City Immigrant rights groups are voicing strong opposition to legislation being proposed in several US states to deny citizenship to American-born children of illegal immigrants.In the latest salvo of a heated immigration debate, Rep. Daryle Metcalfe (R) of Pennsylvania said Wednesday that state legislators will introduce bills to eliminate automatic “birthright citizenship.” He was backed by local lawmakers from Oklahoma, Kansas, South Carolina, Georgia, and Arizona, but the group says legislators from a majority of US states are joining the effort.

Latino organizations in the US and activists in Mexico immediately responded, saying the measure would not prevent illegal immigration, but only create a permanent underclass of workers with no civil rights.

“You’d end up creating a two-caste system in the United States of citizens and noncitizens, [the latter of whom] would be easily exploitable,” says Brent Wilkes, national executive director of the League of United Latin American Citizens in Washington. “It would be like old Europe or India, where you’re born into a family that determines what your caste is.”

'Xenophobic, supremacist' campaign In Mexico, immigrant rights activist and former federal lawmaker José Jacques Medina urged legislators Wednesday to draft a Congressional statement against the “xenophobic, supremacist” campaign to reverse birthright citizenship.

News Flash : illegal immigrants *are* a permanent underclass of workers with no civil rights. We are trying to fix that by forcing them to become legal immigrants. I know it's a complex thought for some, but you have to be a citizen to have a citizen's rights.

I’m sure the illegal immigrants in Mexico love the way that they are treated (raped, robbed, beaten, deported).

Mexico is a beautiful country. It’s the people who need to disappear.

Such a great “progressive” idea to transform a beautiful state like California - the Golden State - into a colony of Mexico.

They export to us their poorest citizens ... and we are stupid enough to assume their social problems ... while letting them make money off this scam.

2 things are seriously stupid here.

State legislatures dont get to decide who is a citizen, that would be the federal governments job.

How many kids are we talking about anyway? Doesn’t seem worth the fight, just fine employers who cant prove their employees are legal and problem solved.

Which is why you are stripping citizenship away from them? Doesn’t make much sense.

How are you making them legal when they are already legal? This doesn’t affect one illegal immigrant.

This is a measure that will have an effect it the future, not those currently with birth certificates. We can't undo what has been done, but we can stop it from happening again.

There will be two kinds of birth certificate; one for children born to citizens, legal residents, and those who have one parent who is a citizen/legal resident. A second would be for children born to non-citizens, and those who can't prove they are here legally.

Since the several states are the ones who decide who is a citizen of their state, and issue birth certificates for those born there, it isn't an issue the Federal Government can get involved in. Naturalization of non-citizens (they get Federal papers issued, not state certificates) and immigration of same is.

The idea is to discourage those illegals who come here to have children so that they can stay. It will go to court, of course. But that is the plan.

Sure, but this would only ever take place after the fact. By the time this is relevant, it’s already too late. You are conceding that you cannot stop it by preventing the entry of illegal immigrants into America.

We can stop it completely by preventing illegal entry into the United States. We have only paid lip service to securing the border to this point. I shall not concede the point in the slightest degree.

Illegals aren't slaves. They broke the law by knowingly crossing the border without authorization from the USA, even dragging their children across in conditions that, had they been citizens, been enough to remove custody of the children from them. Since the children don't belong here either, they need to be shipped back to whence they came, even if born here. Slaves were taken across the seas to these shores by force, against their will. They didn't have a choice. We owed them the right of citizenship. They earned it in the hardest manner possible; by lash, bonds, blood, sweat, and tears in copious amounts. The 14th Amendment's authors were extremely clear on that point. The slaves, by law passed by both the Federal government and the several States, made them subject to the jurisdiction of this country. Slaves couldn't appeal to the embassy or consulate of their home countries for relief. Illegals can, because (note this VERY carefully) they are still citizens of the country they came from.

And if they are citizens of their country of origin their children are as well. They aren't of our ‘house’ at all.

Sadly, this bill does nothing to improve things. It doesn’t improve border security. It imposes no penalty on illegal immigrants.

The only people it hurts are those who are already born in America, not the children who cross over being born in another country. This is the problem.

And children born in America, don’t deserve the same rights and priveleges? They didn’t choose where they would be born.

Children born in America are not illegal immigrants. They have crossed no borders.

This law will remove the incentive of anchor babies being able to legitimize their illegal parents, and later sponsoring their relatives via chain immigration. It does improve things. Until recently AZ hospitals in Tucson were advertising packages for illegals to come over and give birth to their children here, in order to allow them to stay, though they broke the law. While I agree that the law may often be an ass, this is a Constitutional decree. Congress has the power to set the conditions of Immigration and Naturalization, but NOT citizenship of the several States!

It cannot impose penalties on illegals here currently. That isn't the point of the bill. It does remove the incentive to have children here. To try to add penalties against the parents would complicate the matter needlessly, and should be addressed in a separate law. Yes, the child didn't cross the border. But they were born of non-citizens that came here with the intention of circumventing US law, not placing themselves under the jurisdiction thereof. They are being born here in order to circumvent the law. Not an acceptable situation.

Next, it only affects those in the future, not those here now. Ex post facto laws are prohibited. The US Constitution prohibits that specifically, and rightly so. We are looking forward. That is where the focus needs to be.

Just because someone is born within these borders doesn't make them a citizen. They must be born in a condition that is in accordance with the law. Illegals aren't.

If the privileges of citizenship are granted, then how does it even remove this incentive? They still have access to welfare and social services.

Umm, yes, the US congress does have the power to regulate citizenship of the United States. Under the constitutional authority. This can’t be changed unless its through constitutional amendment.

No, the bill will never impose penalties on illegals here currently. It doesn’t target them at all.

Heh, you completely lost my support here. So you are willing to tolerate illegals in the country provided they don’t have access to citizenship? That’s bad. Slaves were cheap labour, eh.

The circumvention of the law occurs when the parents cross the border. Intent to violate the law isn’t a crime until they actually cross the border. They are being born in the US in accordance to the law, not in circumvention of the law. Which is why you are trying to change the law.

The law at present affirms that all those born within the US are considered citizens of the United States.

They are in accordance with the law. There exists no law which says that some people who are born in America are citizens and others are not.

Americans born on American soil are not illegal aliens.
