Could President Obama Invoke Amendment Number 14?

What President Barack Hussein Obama’s press secretary, Jay Carney, by how he is talking, it sure sounds like the Obama White House and the Democrats are getting desperate. It is a sure sign that the Democrats with President Obama are on “the ropes”. The is should come as no surprise because it is a sign that the American people are starting to scream out to the White House, Senate, and House that ENOUGH is ENOUGH. What start with many tea party movement protests going back to early 2009, has come to this late week and the efforts to resolve the federal budget debt stalemate in Washington D.C. and the need to make the needed cuts.

Could President Obama end up invoking the USA Constitution’s 14th Amendment in regards to resolving the federal USA budget debt?

The out-of-control federal budget debt and the out-of-control federal regulations could very much be a BIG FACTOR in the upcoming 2012 USA Presidential elections.

From White House Press Secretary Jay Carney himself:

“We are also realistic. That grand bargain if you will is still on the table. The one that the Speaker of the House walked away from. And while often Republicans don’t like to admit it, they came very close to an agreement. And that agreement is still available. now, if we are not able to achieve that in the next several days, we still need — we have no other alternative, we have to take action to ensure that we do not default. And we have to take action to reduce our deficit.”

The 14th Amendment requires that debts be honored...it does not require, or give power to the President, to ignore the will of Congress in taking on NEW debt.

Obviously this Harvard graduate does not fully understand the Constitution. He has no idea of what the 14th. Amendment is all about. Is he truly that ignorant?

That part of the 14th which goes back to the right after the civil war period about paying war-related debt.

In fact, the amendment expressly grants Congress authority over the amendment....not the president.

Appears to me that the 14th amendment was adopted to address Reconstruction issues relating to the aftermath of the Civil War. Maybe I'm missing something but I don't see how the "validity of the public debt" section was ever intended to be applied to outside of that context:

Section 4. The validity of the public debt of the United States, authorized by law, including debts incurred for payment of pensions and bounties for services in suppressing insurrection or rebellion, shall not be questioned. But neither the United States nor any State shall assume or pay any debt or obligation incurred in aid of insurrection or rebellion against the United States, or any claim for the loss or emancipation of any slave; but all such debts, obligations and claims shall be held illegal and void.

Call his bluff. Let's just sit and wait for Obama do something.

Will he unilaterally adopt a "spending bill" of his own creation?
Will he unilaterally raise taxes on "the rich"?

Dictators get shot for stuff like that.

He won’t be able to get a reputable lawyer to agree that it is legal, but then again he wasn’t able to get a reputable lawyer to agree that his War Powers Act interpretation was legal and that didn’t stop him.

I copied this from ‘somewhere’.........

The 14th says “The congress shall have the power to enforce by appropriate legislation, the provisions of this article”.

Geitner has repeated OVER AND OVER that there is NO 14thAmendment Option that applies here, since CONGRESS controls the purse strings as a separation of powers.

Wondering how much slop is in the budget and revenues. I am betting that if push came to shove that they’d find the money and then some.

Then again, they don’t feel like they have an obligation to follow the budget so the attitude is why bother.

It doesn’t matter what context it is applied in.

The concept of “validity” of the debt has absolutely nothing to do with this crisis. NO one is claiming that the outstanding debt is not “valid.”

It is still a valid debt obligation of the United States even if Barky absconds with the money for the interest payment and flees to Kenya with it. Whether or not the government decides to pay interest or principal on the oustanding debt, it is STILL legally valid debt.

The argument is a giant red herring.

We have talked about his possible dictatorial moves for 3 years now.

Tanks and troops in the streets will not surprise me.

What might suprise The Elites in D.C. is eventually which direction the turrets face, if the United States Constitution is shredded People are pissed on that kind of way.

Constitutional or not, he’ll not waste the opportunity to seize further control of the government. The Republican House may or may not impeach him, but if they do, the Senate will NOT convict, and we will have a de facto dictator.

It’s at least a 50/50 chance of playing out that way.

What happens next year with regard to the election is a little harder to predict.

You say we’d see a new American Revolution. I would hope so, under those conditions, but we’ve already let the constitution be trampled and shredded so badly and we haven’t risen up yet, so I don’t hold much hope that this would do it. People still think they have too much to lose to risk everything like our forefathers did. Sad, I know, but I think it’s true. Most of them don’t even realize what’s happening or the issues involved. They’re too busy listening to their iPods and watching Dancing With The Stars.

In fact it's specifically says who is responsible for enforcing provisions of the 14 Amendment.

Section 5. The Congress shall have the power to enforce, by appropriate legislation, the provisions of this article.

The 14th amendment does not give any President the authority to raise a debt ceiling. Only Congress may borrow money, which is what the debt ceiling really is. Grey Eagle.

Exactly. There is nothing in the 14th that allows a president to borrow money for anything, including servicing the debt.

VERY little! Every $ is directed by someone to someone for some reason... (Much of it for personal gain, but that is the last thing they want to give up.)
