Federal prosecutors are asking an appeals court to reconsider a ruling that threw out a California man's criminal conviction for threatening Barack Obama while he was a candidate for the presidency in October 2008.
In July, a three-judge panel of the U.S. Court of Appeals for the Ninth Circuit ruled, 2-1, that comments Walter Bagdasarian posted on a financial internet bulletin board did not constitute a "true threat" to Obama, even though the suspect was later found to have six firearms in his home. After Bagdasarian waived a jury trial, a federal judge convicted him of two counts of threatening to kill or injure a major presidential candidate.

Instead, the cases in this Circuit teach that even ambiguous language, or language that does not specify that the speaker himself intends to kill or injure, can nonetheless amount to a threat, depending on the full context,” the government wrote.”

But not while Eric Holder is the top cop. AS long as he’s the top cop US “justice” is gonna be exactly like Mexico’s: for sale to the highest bidder (that is, the one with the most campaign cash and/or the most votes). IOW, anybody who would seriously be a threat will get a free pass from the entire law enforcement field.
So I could say, “The sky is red.” And by my visual confirmation, the sun setting in the west is orange and casting a red glow on the sky.
However, since I recently had a dream about Obama falling from AF1 in-flight, I’ve now insinuated that the red sky is his blood as he falls from AF1. And I don’t even have to be the one who pushed him, it’s simply by the fact that I had a dream about Obama falling from AF1 (sans parachute) and noted a red sky at sunset, I’m now guilty of threatening the Resident.

From this, may I infer that there is a 'lesser' charge for those who threaten a MINOR presidential candidate?
By that argument, 75% of the members of “Code Pink”, 90% of the democrats in congress, Michael Moore and Keith Olbermann should ALL be behind bars for ‘threatening’ president George W. Bush.”

* Obama about Republican congressmen: “They can come for the ride, but they gotta sit in back” It does look like Obama is derailed and is desperate. Virtually everything he does now is blowing up in his face. He is so obviously anti-American, that even Democrats are seeing it. This Socialist/Marxist Muslim and Community Agitator is going down.
This part of the government's argument is not relevent to the case because Mr. Obama is clearly NOT a 'qualified individual'.
You can win a bet on that one. But who's going to call him out? Major news media? The Feds?
