Disagree with Perry’s position: discount education for people who shouldn’t be here when you won’t give citizen out of staters the same consideration? Really?

Couple of issues. There is nothing in the law requiring people to "be working toward US citizenship." The law states the following:
(4) provides to the institution an affidavit stating that the individual will file an application to become a permanent resident at the earliest opportunity the individual is eligible to do so.
This is a sham that is not enforceable. The illegal alien may never become eligible. In the meantime they get in-state tuition and take the place of an American citizen/legal Texas resident who is qualified to attend the school, which is also subsidized by the taxpayer.
Re standing up under legal challenge, please take a look at an ongoing case filed in April 2010, Immigration Reform Coalition of Texas v. State of Texas (University of Houston). The lawsuit claims the state law violated the federal Illegal Immigration Reform and Immigrant Responsibility Act of 1996, which prohibits states from providing a postsecondary education benefit to an alien not lawfully present in the United States on the basis of residence unless any U.S. citizen or national is eligible for the same benefit.

I was leaning toward Perry until last night. He really lost me with his immigration remarks. I am not going to be able to get past it and I think it put off a lot of folks. I don’t want to face that amnesty fight again that Bush put us through.
If the representatives of the state are so out of touch with the people, why are they in office?
Illegals should not be serving in our military. Illegals should not be here. Illegals should be deported. Illegals should be prohibited from ever gaining US citizenship. Anyone employing illegals should be prosecuted and given prison sentences. Any politician pandering to illegals should be removed from office. Now do you understand?
Perry isn't perfect. None of them are. In order to get perfect, we'd need a robot with founding documents software. BUT, if Perry goes down, that could leave us with a NE liberal named Romney. We've got to be careful not to jump out of the frying pan and into the fire.
All kids are where they are becasue of their parents. You are right on point. Why should invaders get special treatment?

AN ACT
relating to the eligibility of certain persons to qualify as residents of this state for purposes of higher education tuition or to pay tuition at the rate provided to residents of this state.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Section 54.051(m), Education Code, is amended to read as follows:
(m) Unless the student establishes residency as provided by Section 54.052(j) or 54.057, tuition [Tuition] for a student [students] who is a citizen [are citizens] of any country other than the United States of America is the same as the tuition required of other nonresident students.
SECTION 2. Section 54.052, Education Code, is amended by adding Subsection (j) to read as follows:
(j) Notwithstanding any other provision of this subchapter, an individual shall be classified as a Texas resident until the individual establishes a residence outside this state if the individual resided with the individual’s parent, guardian, or conservator while attending a public or private high school in this state and:
(1) graduated from a public or private high school or received the equivalent of a high school diploma in this state;
(2) resided in this state for at least three years as of the date the person graduated from high school or received the equivalent of a high school diploma;
(3) registers as an entering student in an institution of higher education not earlier than the 2001 fall semester; and
(4) provides to the institution an affidavit stating that the individual will file an application to become a permanent resident at the earliest opportunity the individual is eligible to do so.
“Get America working again”...at low paying jobs.

I don't follow. Why would we have to give the amnesty or change the employment laws just because they have a degree?
Why do states have to CONSTANTLY pay up, clean up and feel the fall out from Federal inaction? We didn't pay our state taxes to hire police in our cities and towns to be immigration cops (instead doing their usual jobs).
We PAY FEDERAL taxes for our government (most important duty the Federal government has) TO PROTECT and defend the country and its citizens. THE FEDS need to have their ears pinned back and told WE ARE NOT GOING TO do this for you any more.

The illegal alien may never be eligible to apply and is under no compunction to do so. How is it going to be enforced? In the meantime, he/she gets in-state tuition. This is just another scam by the politicians to fool the people.
Why are we educating these people? Federal law says it is illegal for illegal aliens to work in this country and it is illegal for empoyers to hire them. They can't get a driver's license. And unlike what Perry said, they are ineligible for welfare benefits, "the Dole."
Most of the ones who were involved with this ARE out of office! The problem is the lobby and big money republican donors like Bob Perry of Perry homes Inc. who indirectly benefit greatly from illegal labor.
It takes at least 5 years for those from Mexico to obtain US citizenship. So I would assume that is what “working towards citizenship” means. And that is for legal aliens, not sure how long it would take children brought in illegally by their parents.
