Judicial Watch, the public interest group that investigates and prosecutes government corruption, announced today that it has obtained three new documents that provide additional information about Supreme Court Justice Elena Kagan and the Affordable Care Act (also known as Obamacare) while she served as solicitor general. Justice Kagan has said she was not actively involved in the Department of Justice (DOJ) discussions regarding Obamacare. Moreover, the Supreme Court justice did not recuse herself from the High Court decision in April 2011 not to fast-track for Supreme Court review Virginias lawsuit challenging Obamacare. Kagan has the same ethics as any other Liberal Democrat Dyke.

I am paraphrasing the question and answer:
Was Justice Kagan involved in discussions about Obamacare?
Holder: No she was asked to leave or removed from the room when this subject came up.
My question is why was she excluded or removed from the room? Did they know she was going to become a SC Justice way back then?
I think Holder lied to cover for Kagan so she would not be subject to recusing herself.

Check out this video of Sen. Lee (R-Utah) asking Holder a question about Obamacare. His question begins at 111:08 into the video.
Given Laurence Silberman’s vote and opinion just rendered from the First Circuit, I think none of this matters. He is a conservative Reagan appointee, a co equal in stature with Scalia in his knowledge and in his constructionist views. Many consider him a mentor to Chief Justice Roberts. So my view is that Silberman’s opinion on Obamacare and the mandate, that they are within the powers of Congress under the Commerce Clause, will have great influence on Roberts and Scalia’a decision.
More evidence that Obama”care” will get the majority support from the rigged NINE SUPREMES.

The difference at this point her involvement and glee at Obamacare’s passage is known and on the record.
That said, if Kagan chooses not to recuse herself, she has to consider whether a newly elected Republican house, senate, and president would bat an eye at both repealing Obamacare and impeaching her?
I doubt it!
Given her both involvement and glee at it’s passage, and the fact that both are now known, she takes a tremendous risk if she does not recuse herself.
