Emails show Elena Kagan gushing over Obamacare passage: “I hear they have the votes, Larry!!”

This, on top of the fact that we already know Elena Kagan huddled with the White House to help craft the legal defense for Obamacare just five months prior to being sworn in as a Supreme Court justice.

A case for recusal doesn’t get much more clear-cut than this. Don’t hold your breath though waiting for Kagan to recuse herself when the Obamacare challenge lands in the Supreme Court; this is exactly why Obama nominated her.

(CNSNews.com) – On Sunday, March 21, 2010, the day the House of Representatives passed President Barack Obama’s Patient Protection and Affordable Care Act, then-Solicitor General Elena Kagan and famed Supreme Court litigator and Harvard Law Prof. Laurence Tribe, who was then serving in the Justice Department, had an email exchange in which they discussed the pending health-care vote, according to documents the Department of Justice released late Wednesday to the Media Research Center, CNSNews.com’s parent organization, and to Judicial Watch.

“I hear they have the votes, Larry!! Simply amazing,” Kagan said to Tribe in one of the emails.

Says it all. Will she? Is it time for another massive Tea Party rally in Washington D.C. about this very issue? How about right in front of the SCOTUS building?

The same liberals who insist that Justice Thomas recuse himself for the most tenuous and indirect connections - his wife's involvement in health care - will not say a WORD about this blatant conflict of interest.

Is anyone surprised by that?

She shouldn’t’ be on the Supreme Court period. Who were the fools that voted for her. They should go.

It’s my understanding that there is no mechanism to force a Supreme Court justice to recuse, short of public shaming and the threat of impeachment. Since I doubt Kagan cares about the former and knows the later will never happen. I expect her to laugh as she issues her “unbiased” decision.

If she were still Solicitor General, she would be the one making the oral arguments for the government in front of SCOTUS. Her successor is the one that will likely be doing so.

She was a huge cheerleader for this bill, sat in on meetings where details of the bill were being hashed out.

If that is not grounds for recusal, then no judge should have to recuse themselves from any case.

Not sure what they could do other than cry and whimper about it.

Impeachment is, as far as I know, the only option - and it just isn’t in the cards - at all.

So what would you have them do?

She’s a DEMOCRAT, so normal rules do not apply. The gays running today’s major media will see to that.

This is a clear case where she can not be unbiased. She must recuse or she will break the law. The statute is quite clear that she must step aside. She knew that when she got on the court. We can file judicial ethics violations in the federal judiciary and she could lose and be forever scarred .

The House of Representatives must immediately begin assembling articles of impeachment against Supreme Court Justice Elena Kagan based on her committing perjury during the Congressional selection process.

Kagan isn’t a deciding vote anyway. All four dems will vote against us. The fix is only in if Scalia and/or Kennedy decide the government can do whatever the hell it wants to do.

Agree with your #14 - provided, of course, there is clear evidence she lied (embarrassed to say I do not have all the facts). If she lied to gain a seat on the highest court and no action is taken, then the entire exercise was a fraud on the taxpayers/nation.

Further, another sitting-on-the-hands in the face of something such as this that is fundamental to the efficient operation of our government, clearly indicates our political leaders are ignoring their Constitutional obligations.

Allmendream, you stated upthread that impeachment was out of the question. If you mean it is unlikely the Republicans will rise to the challenge, you may be correct. If otherwise, would you share your thoughts on that point?

I’m thinking of this article on Sipsey Street Irregulars, not specifically about 0bamacare or Kagan, but about the goverment malfeasance and what it signifies.
