Will Obama send U.S. citizens to Guantanamo? Outrage as President signs off law...
Daily Mail ^ | 12/15/11 | Meghan Keneally

President Barack Obama faced a civil liberties backlash today after he signed a law that will allow terror suspects to be held indefinitely- even raising the prospects of U.S. citizens being sent to Guantanamo Bay. The controversial move, revealed last night, effectively extends the laws of the battlefield to American soil.

The move shows a clear hardening of Mr Obama’s anti-terror policies, and a major shift from the liberal stance that helped him sweep into power three years ago.

Obama is so deceitful and powerful that he was able to convince 42 Republican Senators to vote to give Obama the power to send innocent patriotic Americans to Gitmo.

It was sure nice of the Republicans in the House and Senate to give Obama the power to send citizens to Gitmo simply for voting Republican.

I personally do not even blame Obama as much as I blame Congress. Their specific job is to read the bills and vote based on what they have read, NOT based on what the president has said. These Republicans scare me more than the Democrats because at least Democrats tell you that they are Socialists.

Yes. I originally was not as worried and thought it was Conspiracy hype until I read about them stabbing the American people in the back and removing the clause that exempts American Citizens.

http://www.campaignforliberty.org/profile/7786/blog/2011/12/01/urgent-second-chance-prevent-indefinite-detention-americans

Senate Amendment (SA) 1126 would “clarify” Section 1031 to explicitly state within the section that the authority of the military to detain persons without trial until the end of hostilities does not apply to American citizens. [Update: Voted down 45-55]

SA 1125 would limit the mandatory detention provision in Section 1032 to persons captured abroad, not in America. [Update: Voted down, 45-55]

Here is a (the?) section that talks about it. Not sure what “exceptions” can be made - but U.S. citizens or Legal Resident Aliens can NOT be detained under the new rules.

***************************************

Sec. 1032. REQUIREMENT FOR MILITARY CUSTODY.

(a) Custody Pending Disposition Under Law of War-

1
(1) IN GENERAL- Except as provided in paragraph (4), the Armed Forces of the United States shall hold a person described in paragraph (2) who is captured in the course of hostilities authorized by the Authorization for Use of Military Force (Public Law 107-40) in military custody pending disposition under the law of war.

(2) COVERED PERSONS- The requirement in paragraph (1) shall apply to any person whose detention is authorized under section 1031 who is determined—

(A) to be a member of, or part of, al-Qaeda or an associated force that acts in coordination with or pursuant to the direction of al-Qaeda; and

(B) to have participated in the course of planning or carrying out an attack or attempted attack against the United States or its coalition partners.

(3) DISPOSITION UNDER LAW OF WAR- For purposes of this subsection, the disposition of a person under the law of war has the meaning given in section 1031(c), except that no transfer otherwise described in paragraph (4) of that section shall be made unless consistent with the requirements of section 1033.

(4) WAIVER FOR NATIONAL SECURITY- The Secretary of Defense may, in consultation with the Secretary of State and the Director of National Intelligence, waive the requirement of paragraph (1) if the Secretary submits to Congress a certification in writing that such a waiver is in the national security interests of the United States.

(b) Applicability to United States Citizens and Lawful Resident Aliens-

1
(1) UNITED STATES CITIZENS- The requirement to detain a person in military custody under this section does not extend to citizens of the United States.

1
(2) LAWFUL RESIDENT ALIENS- The requirement to detain a person in military custody under this section does not extend to a lawful resident alien of the United States on the basis of conduct taking place within the United States, except to the extent permitted by the Constitution of the United States.

How is it possible that this is not in the Breaking News or Front Page News sidebars?

Let alone having it's own Subject Link at the top of the page?

The American Constitution was just eliminated by congressional vote. I would think that a website called Free Republic would find that somewhat important.

I don't know what's scarier - the vote, or the universal silence about it.

We're about halfway to the results of a democracy. Which is why The Founders gave us a republic. A combination of events including the 17th Amendment to the Constitution, and the take-over of the educational system by Marxists/Leninists in order to destroy the educational system over the last 45 years or so has moved our form of government to a defacto democracy.

The Founders knew that throughout history, where ever it was tried, democracies always devolved into authoritarian or totalitarian, tyrannical governments.

And that's right where we're heading.

By the time this plays out, the US will have become a police state where you no longer have liberty.

Without security of your person, your property and your privacy, you have no liberty. It simply an
illusion of freedom - granted only if the state likes you.

In the not too distant future, you will wish you had arranged for another passport of
another country, shipped your wealth offshore and set up a bolt-hole far from here...
that is, if you haven’t already done so.

Time is running out.

21twelve,

If you read the last sections closely they say the president is not required to hold American citizens indefinitely. Which means he can hold throw them in the gulag forever, as long as he is not required to do so.

As, the government can ask for a waiver to begin pulling folks out of line despite the fact they are not working for al queda.
