Perry's lawyers said a preliminary injunction was necessary since the deadline to print ballots in Virginia will be in two to three weeks.
“In the absence of a preliminary injunction, plaintiff will suffer irreparable harm,” per filing.
The case is Perry v. Judd, 3:11-cv-856, U.S. District Court, Eastern District of Virginia in Richmond.

If the State of Virginia makes Perry present a photo ID, he should sue for discrimination since he is a dark horse.

Texas Gov. Rick Perry’s campaign said on Tuesday that it is filing a lawsuit to get on the ballot in the Virginia primary election after state officials announced last week that he failed to turn in the requisite 10,000 signatures.

And Texas’ Super Tuesday GOP primary election is being delayed because the GOP redistricting case has a calendar date on the Supreme Court.

Perry’s suit is fighting for the PEOPLE of VA.
Fighting to ensure ballot access.
They must “promise” to support their vote choice.
Right.
And no “write-ins” allowed.
Open Primary.
Virginia thinks they are punishing the various campaigns for not following their rules but in fact they are punishing their constituents who are not allowed a choice in the our Virginia primary.
They should change the rules for Virginians’ sake not for the candidates. Their rules only hurt Vrginians.

I know major population centers are D.C. Beltway centers, however this is manipulative to the point of restricting ballot access.

No, the article states they must support the "eventual Republican nominee" in the general Presidential election, basically meaning if they vote Newt in primary and Romney is the eventual nominee, then the oath requires them to support Romney in the Presidential.
Here in Texas you sign your Voter Registration Card as to which party's primary you voted in.

If Perry gets a declaratory judgment that the VA ballot rules or the Va Republican Party’s manner of implementing them are unconstitutional, then Gingrich will benefit & gets another shot at getting on the VA ballot, even without mounting his own legal challenge.
So Gingrich gets the benefit, without getting mauled by the MSM (any more than he already has) for “whining.”

I would rather had each candidate follow the Virginia rules when gathering signatures for petitions.
And I would like someone to tell me how exactly those rules were different for Rick Perry and how Romney and Paul were treated more favorably by the Republican Party of Virginia.

Apparently, Paul and Romney turned in enough signatures or much more than the required number of 10,000 and more than the suggested number of 15,000 signatures.

Do you know for a fact that the party gave preferential treatment to GOP Establishment Insiders like Romney and Ron Paul?
I’m sure that I’m not alone in this, if I had known more signatures were needed and had access to sign the petition I would have signed it. Given the restrictions on the petition circulators, I would have probably had to drive a good distance to find one.
I know for a fact that they did not scrutinize their signatures.

Did armed agents of the Republican Party of Virginia prohibit citizens from signing Rick Perry’s petition?
Do you believe that of the 12k of signatures Perry submitted only 4K to 6K were valid?

As I understand it Rick Perry did not collect 12,000 signatures.
And I think we are all aware of voter fraud, voter registration fraud and petition fraud.
Therefore, it would not surprise me if people signed the Perry petition who were not qualified to sign the petition or of some of those collecting petition signatures may have taken some short-cuts.
Finally, it important that we as a nation and each state and political party take measures to eliminate voter fraud, voter registration fraud and petition fraud.
They weren’t looked at, at all because they exceeded the magic # of 15K

He submitted 11,911 signatures.
Newt got screwed too, but instead of recognizing that the VA process is BS you’d rather bash Perry.
The suit is based on precedence regarding the constitutionally of requiring that petition circulators must be registered to vote or be eligible to vote in Virginia, thereby restricting voter access to sign petitions. The USSC has ruled that petition circulators can be from outside the state.

The lawsuit that has been filed claims that the VA GOP violated Rick Perry’s constitutional rights.
However, as conservatives, we both know that a private organization, such as the VA GOP does not have to extend constitutional protections to people.
This motion is likely to answer that.
It's a perfectly legal process, so there should be no problem with letting it go through.

Largely it states that VA voters were denied access to candidates on the ballot.

The 3 members of the State Board of Elections are also defendants in the lawsuit.
