Georgia Judge Michael Malihis refusal to accept President Obamas lawyers demand that he be excused from responding to a subpoenato testify in a hearing questioning his eligibility to appear on that states presidential ballot was denounced by Edward Toady, lead attorney for the president on this case.
The president is the sovereign ruler of this country, Toady asserted. Where he goes and what he does is solely at his discretion. He does not have to answer to the demands of lower ranking authorities. He has what is called sovereign immunity.
On top of this, there is the simple lack of time in the presidents busy schedule, Toady added. The president isnt like ordinary people. He doesnt have a free moment to spare. Every waking hour is already allocated to activities of higher priority. Satisfying some plaintiffs curiosity as to whether he is qualified as a natural born citizen is an unwarranted intrusion on this mans privacy and tries his patience.
Judge Malihi dismissed Toadys claims as unsupported by any evidence or cited legal authority. Im not saying that the contention that a president may not be compelled to attend a court hearing is necessarily incorrect. However, Mr. Toadys contention that the Presidents status of acknowledged leader of the free world makes him immune is an argument without substantive legal foundation. Further, the argument that the President has no time to spare would seem to be refuted by his widely reported indulgences in elective recreational activities. Surely, the resolution of this legal issue could take precedence over another round of golf.
The presidents lawyers say they will appeal Malihis decision to a higher authority. Under our legal system a person has the right to be judged by his peers, Toady observed. Judge Malihi is merely a state court judge. As such, he lacks the stature to sit in judgment of the President. In fact, it is our contention that the President sits on the pinnacle of American government and is without peer. As the highest authority in our government he is the only person who can judge himself. As long as he holds that post no one may presume to tell him what to do.
if you missed any of this week's other semi-news posts you can find them at...
Always have to watch out for that “Semi News, Semi Satire” thing before posting in outrage d;^)
Ha Ha! I only wish that the Judge had used a 2x4 to send the message back to the idiot occupying the White House. =.=
Nothing would surprise me.
Yeah, I saw that “sovereign immunity” defense and my blood pressure started to rise and just then . . . I said I better check and see . .
I laughed. Great headline.
I have never read that in our constitution...
Elected official, yes. But certainly not above the law!
King George was a “Sovereign”, that is until the founders and the people of this land told his Armies otherwise...
Is anyone else seeing something ominous here? With language like this, I am very concerned about upcoming national elections....
sov·er·eign (svr-n, svrn)

3. A gold coin formerly used in Great Britain.
[Middle English soverain, from Old French, from Vulgar Latin *supernus, from Latin super, above; see uper in Indo-European roots.]
The president isnt like ordinary people. He doesnt have a free moment to spare. Every waking hour is already allocated to activities of higher priority.
You mean like some of the 90 plus rounds of golf, not to mention the numerous uncounted campaign events, speeches, fund raisers, and other distractions to actually doing something for the country instead of to it.
“The president is the sovereign ruler of this country.”
Last time I checked....we have no sovereign. Of course we have always suspected that Zero and Moochelle considered themselves royalty....
Good catch, I let that one slide right by me. Scary, must be getting used to the Sovereign Ruler idea.
Yeah, that’s right. King Obama shi!s on everyone. After all a dictator self appointed King is absolute ruler over his subjects including judges.
Okay, now I see the semi-news/satire link.
NOT Funny. Lesson learned.
I think we may need another Declaration of Indepence. Let King BO know,we don’t need no stink’n King.
Thanks for the ping.
Independence. I have some weird form of lexdisia.
I got caught in one of these one time so I always check. :-)
